Mel Gibson has been seen in public for the first time since it was confirmed that assault charges against him have been dropped, and he was spotted smiling from ear-to-ear.

The 59-year-old actor was joined by new girlfriend Rosalind Ross, 24, as the pair enjoyed a romantic dinner date in the Kings Cross area of Sydney, Australia on Saturday evening.

The New York native cut a casual figure for his date night, donning a waxed leather jacket, with a black T-shirt and loose, stonewash jeans.

Despite seeming very happy indeed as he was accompanied by his equestrian vaulter lover, the father-of-eight did appear a little fatigued as he held his jaw after departing the restaurant.

Rosalind looked to have co-ordinated wardrobes with her older beau, sporting a leather jacket with grey skinny jeans.

Seen grinning alongside Mel, she completed her look with a studded off-the-shoulder handbag, her jet-black locks styled away from her face.

The pair's jovial public appearance comes after it was confirmed that allegations that Mel attacked a female photographer and subjected her to a verbal tirade outside a Sydney cinema have been dropped.

New South Wales Police confirmed to Daily Mail Australia on Thursday that no action will be taken. 

'The matter was reported appropriately and investigated thoroughly and based on the evidence gathered, at this stage, no formal action will be taken,' a spokesperson said.

Kristi Miller, the female photographer at the centre of the controversy, had stood by allegations that the actor pushed her during a verbal tirade, on August 22. 

The mother-of-three claimed to have been berated by Gibson as he left the Palace Verona Cinema on Oxford Street in Paddington, Sydney, with girlfriend Rosalind.

'There is no suggestion that what this woman suggested had occurred, ever happened,' his lawyer Christopher Murphy said.

'Police have completed a thorough investigation of allegations made by a Sydney photographer and have concluded there is no evidence to substantiate any charge against my client Mel Gibson.'

He said Mel Gibson had totally denied the allegations from the outset.

'He is now satisfied that the police, after speaking to witnesses and reviewing CCTV footage and other evidence, have found there is no substance to the claim,' Mr Murphy added.

The lawyer said the legendary actor was 'enormously insulted and upset' by the claims and they had been 'damaging' to his name.

Before the allegations were dropped, The Daily Telegraph reported that Rosalind refused to give Australian police a statement regarding the incident - although according to the photographer involved, she apologised for Mel's behaviour at the time.

Speaking to the Daily Telegraph on Monday, the photographer claims she was 'no less than ten feet away' from the actor when he approached.

'I wasn’t close enough to be in his face at all,' she said. 'I stayed that exact distance away and I took a turn in front of them, staying that distance away from them, and I ran to get ahead of them.'

She claims she was then shoved by the star as he hurled abuse at her while making his way towards Oxford Street with his girlfriend.

She added: 'I don't want sympathy, I'm not injured, but I do think his behaviour is appalling and I don’t want to pull the female card but I am a female and I don’t think a male should speak to a female that way.'

The photographer previously claimed it was only when Rosalind grabbed the star's shoulder and attempted to drag him away that he backed off.

She is alleged to have told the stunned photographer, according to The Australian: 'Sorry, he's a bit sick at the moment.'

The couple first met when Rosalind applied for a job at Gibson's production company, Icon, and have been dating since July. 

Mel split from Russian pianist Oksana Grigorieva in 2010, with whom he has a daughter, five-year-old Lucia.

He also has seven children from a previous relationship with ex-wife Robyn Denise Moore, who he was married to for 26 years before splitting in 2006.
