Rock band Survivor not happy that Kim Davis walked on stage to their song Eye of the Tiger after release from jail for refusing to issue marriage licenses to gay couples
- Band's Facebook page posted that they did not give rights for song's use
- Davis was introduced by Republican presidential candidate Mike Huckabee as the song played in the background and she greeted assembled crowd
- 'I would not grant her the rights to use Charmin!' said post authored by 'fs', presumed to be the arena rocker's guitarist Frankie Sullivan
- He also compared Huckabee to Donald Trump and said he could 'do better'
- Trump was criticized by Bernie Sanders supporter Neil Young in June after the GOP front-runner used the rock legend's 'Rockin' in the Free World'
The band behind the tune that accompanied anti-gay marriage clerk Kim Davis on stage at a rally Tuesday says they do not condone her use of their hit.
Survivor's song Eye of the Tiger played as Davis as she went on stage following her release from jail for refusing to give same-sex couples marriage licenses in Rowan County, Kentucky.
'NO! We did not grant Kim Davis any rights to use "My Tune -The Eye Of The Tiger,' the band posted on its Facebook page.
The rock band Survivor has taken issue with the use of their song Eye of the Tiger being used at a rally as Kim Davis, a Kentucky county clerk who refused to issue marriage licenses to gay couples, took the stage. The song's opening lines, 'Risin’ up, back on the street, did my time, took my chances' accompanied its well-known chords as the recently released worker took the stage next to evangelical pastor and presidential candidate Mike Huckabee.
The song was the theme song to the movie Rocky III in 1982 and also won the Academy Award for Best Original Song.
Davis was put in custody of US Marshals last week, but released by US federal judge David Bunning as long as she does not 'not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples'.
'Thank you all so much, I love you all so much. I just want to give god the glory. His people have rallied and you are a strong people,' Davis said at the rally after Survivor's 1980s arena rock hit was turned down.
The authors of Eye of the Tiger seemed to disagree with Davis's actions and the rally, where some attendees held crosses but others held signs such as 'AIDs, judgement or cure?'
'I would not grant her the rights to use Charmin!' the post signed by 'fs', presumably guitarist Frankie Sullivan, said.
The rocker also had words for Huckabee, who was joined in welcoming Davis out of prison by rival candidate Ted Cruz.
The band (pictured) posted a message on its Facebook page saying that they had not given any permissions for the rally to use the song, which became a hit in the early 1980s
'I would not grant her the rights to use Charmin!' said a post signed by 'fs', presumably guitarist Frankie Sullivan (pictured in 2013)
'C'mom Mike, you are not The Donald but you can do better than that,' Sullivan said, referencing a Republican nominee front-runner Donald Trump.
The Davis incident is not the first time in recent memory that conservative politicians have come under fire from artists for their song selection.
Survivor filed an injunction against Republican candidate Newt Gingrich in 2012 for using Eye of the Tiger.
In June guitar legend Neil Young took issue with Trump's use of his song 'Rockin in the Free World' for a rally announcing his run for president.
Young said that he is a longtime supporter of socialist candidate Bernie Sanders.
Trump's campaign responded that it had licensed the song through the music rights organization ASCAP, though Rolling Stone says that the group's rules include that those using songs for political messages must ask the owners.
An attorney for Davis, who says that granting marriage licenses to homosexual couples violates her religious beliefs, said that she plans on returning to work this week.
In her absence her office has been issuing marriage certificates from 'Rowan County' generally, rather than having her name on them.
The song became a hit after it was used as the theme to the third Rocky movie. Above, a still from the movie where Sylvester Stallone's character Rocky Balboa hits Mr T's Clubber Lang
