Messy night? Mischa Barton sports a large stain on her silk top as she parties in West Hollywood

Mischa Barton treated herself to a night on the town on Monday.

The 29-year-old actress partied the night away The Nice Guy in West Hollywood and was spotted leaving the celebrity hot spot flashing her tanned legs in a two-piece romper.

It must have been quite a night as the former O.C star displayed a large stain on her silk top.

Mischa teamed the outfit with a couple of necklaces and black trainers with thick white soles. 

Her hair was pinned up and she wore just a little eye make-up for a natural look.

Hours before, the actress shared a video clip to Instagram as she celebrated the holiday weekend with pals. 

She is seen singing along to Macy Gray hit I Try with three of her friends on a car ride and captioned the clip 'Happy Labor Day'. 

The outing comes as it was revealed that Mischa is being sued by LA producer Daniel Lief after he claimed she was a no show for his movie Promoted, which he paid her $20,000 up front to star in.

'Mischa was paid $20,000 in advance to shoot the entire film. She was supposed to be the star,' Lief told Radar Online.

'Just prior to the first day of shooting, we got an email from her rep saying that she had decided to not take part.'

The screenwriter said 'She took our money, didn’t show up and then refused to give us the money back.'

Mischa is being hit by a lawsuit for 'breach of two contracts to provide services for the film.' 

Meanwhile, the actress is preparing for a return to the small screen.

Mischa has landed a guest starring role in upcoming drama Recovery Road.

The show, to be aired on ABC Family next year is based on the young adult novels by Blake Nelson, which centre around teenagers being treated for addiction at a rehab centre.

Mischa will portray a girl named Olivia, who is a patient at a different facility and forms a friendship with Vern, played by Mean Girls’ Daniel Franzese.

The blonde beauty was famously arrested for a DUI in 2007, and two years later she was sectioned on a 5150 psychiatric hold for two weeks.  

Mischa rose to fame at the age of 17 in 2003, when she joined hit show The O.C. where she played the role of Marissa Cooper for three series until 2006.

Since then she has appeared in small films, and is a frequent attendee at fashion shows for top designers in New York and Paris.
