American Idol star Constantine Maroulis has appeared in court after a second arrest over his turbulent break-up with ex-girlfriend Angel Reed.

The singer was detained in August for allegedly breaching a restraining order held against him after Reed, the mother of his four-year-old daughter, complained that he had emailed her.

However, when they appeared before a judge at Wyckoff Municipal Courthouse in Wyckoff, New Jersey, Reed's lawyer said she would like to dismiss the charges in the interest of both parties.

Maroulis arrived in a black Jaguar that he drove himself at around 6.15 pm before sitting in his car until his lawyer arrived 30 minutes later.

Reed, dressed in a formal black pencil skirt and gray blouse, arrived at the same time but entered the courthouse separately with her lawyer.

Maroulis, wearing a navy blue suit and black tie with a black handkerchief in the pocket and black shoes, looked subdued as he sat at the back of the room - on the opposite side of the courtroom from Reed.

He whispered a few words to his mother and the unidentified woman who was sitting next to him before his case was called.  

Reed and her lawyer met with the judge in a separate room before the case was called and promptly dismissed. 

The judge seemed pleased about the decision and said that there would be a conditional dismissal providing there were no other complaints brought back to the court within six months.

According to TMZ, Maroulis claims he sent the email by mistake, accidentally CCing her in on one meant for his lawyers.

Just a week before, she had him arrested following a domestic violence incident, which he later claimed he was the victim of, rather than the perpetrator.

The email in question outlined his version of events which lead to the altercation on Wednesday night.

Maroulis even filed for - an was successfully granted - his own temporary restraining order against her. 

She had accused her baby daddy of pushing her over then kicking her in the crotch at their Wyckoff, New Jersey, home. 

But the star's representative said Constantine was not the aggressor, alleging Angel became physical first.

The rep told the People Magazine: 'He has injuries on his upper thigh. He was trying to be a nice guy because he is the father of their child and he became the victim.

Police arrested Constantine after his girlfriend called 911 and said he'd thrown her to the ground and kicked her in the groin, but the representative claims there is a recording which suggests otherwise.

'[On the tape] he says, ''I want to break up with you, don't hit me, leave me alone, don't touch me.'" 

The star's representative said he now plans to file criminal charges against his Broadway actress girlfriend and also take her to civil court so that he can see his daughter Malena.

The rep continued: 'Police know he is a good guy. People who know him and know the situation have been incredibly supportive.'

Not done there the star - via his rep - also released an official statement claiming his now ex is 'unstable' and has a history of domestic violence against him.

In the statement his rep says: 'During the course of the attack she hit him with her fists and threw numerous objects at him. He sustained a bruise and cut on his right thigh. 

'He consequently left their home to protect himself and to diffuse the situation. 

'When all the facts come out it will become clear that Mr. Maroulis was the victim here and Ms. Reed was the aggressor. Ms. Reed has a history of attacks on Mr. Maroulis and his property and these have previously been reported to law enforcement. 

'Mr. Maroulis intends to defend himself vigorously, as well as protect his child, both in the court of law and, as necessary, in the court of public opinion and is confident that he will be completely vindicated when the truth is known.'

The Tony-nominated performer and Angel began dating in 2009, after meeting while working on his hit Broadway show Rock of Ages.

The 'American Idol' alum came in sixth place in the reality show's fourth season, which was won by country star Carrie Underwood.
