Florida man, 91, 'made landscaper get on his knees before shooting him because he sprayed grass clippings on his car'

- Another landscaper intervened after Horton fired a bullet and the two men tackled the senior citizen to the ground
- Horton was charged with attempted first-degree murder and is being held without bond at Highlands County Jail
Max Horton, 91, was arrested on Thursday after he fired a gun at landscapers outside his Florida home
A 91-year-old Florida man was arrested after he shot at landscapers who sprayed grass clippings on to his car, police said.
Max Horton, of Avon Park, was at his home on Thursday when he saw landscaper Robert Hendrix get lawn clippings on the senior citizen's car, according to the Highlands County Sheriff's Office arrest report.
Horton argued with Hendrix, and the confrontation turned violent when Horton pulled out a gun and told Hendrix to get on his knees.
He reportedly told the landscaper that he was going to kill him, according to WTSP.
Another landscaper, Johnny Barnes, who was at the scene, moved toward Horton to intervene, and at that moment Horton fired a round at Hendrix before turning toward Barnes.
Hendrix got up from his knees, disarmed Horton and he and Barnes tackled the man, holding him down until police arrived.
Horton suffered a black eye and minor injuries in the dispute and was taken to Highlands Regional Medical Center for treatment.
He could not be taken to Florida Hospital - which was just a mile from the man's house while the former center was more than 14 miles - because he had previously made threats to staff at the hospital.
In September 2013, Horton reportedly told Florida Hospital staff that he had a gun in his vehicle and that they would be sorry if he retrieved it.
Neighbors told police on Thursday that Horton, who is retired, is known to 'flip out' and 'get angry for no reason.
His wife of 69 years, who has not been named, said in the arrest report that her husband 'has always acted violent', according to the New York Daily News.
After the incident on Thursday Horton was charged with attempted first-degree murder. He is being held without bond at the Highlands County Jail.
