'I cannot work with this monster': Kesha asks judge to issue injunction letting her pursue music career as legal battle with Dr Luke drags on

Kesha has asked a judge in New York to issue a temporary injunction that would allow her to reignite her music career even as her legal battle with Dr. Luke continues.

The Tik Tok singer, 28, filed a sexual assault civil suit against the super producer in Los Angeles last October alleging he had drugged her and raped her and threatened to take away her publishing rights.

Now her legal team is arguing, according to the NY Daily News, that the pop star shouldn't be penalized professionally as the lawsuit drags on, arguing that 'unless the court issues this injunction, Kesha will suffer irreparable harm, plummeting her career past the point of no return.'

Dr. Luke - real name Luke Gottwald - has denied the allegations and has not been charged with amy crime.

He lodged his own defamation lawsuit in New York, saying the singer had fabricated the supposed incidents in an extortion scheme to get out of an exclusive recording contract.

In the new filing, Kesha - real name Kesha Rose Sebert - repeated her accusations against the music producer who she said forced himself on her shortly after her 18th birthday and threatened to destroy her career if she ever 'stood up' for herself.

'So I beg of you to please consider letting me put out my music without me having to work with him, please,' she wrote in the documents obtained by the NY Daily News.

Since Dr. Luke has the star under contract, she is unable to work with other producers, record labels or music publishers to release new music.

The issue is further complicated because the singer and songwriter amended her civil complaint in June to include Sony Music Entertainment, claiming the company turned a blind eye towards Dr. Luke's abusive treatment of her.

Kesha's attorney Mark Geragos, who has represented a roster of high profile celebrities in legal cases, is arguing that she should be allowed to 'pursue her passion' despite the ongoing litigation. 

He added that Dr. Luke and the other parties to Kesha's recording agreement 'can easily be compensated with damages if they were to prevail' down the line.

A spokesperson for DR. Luke told The Hollywood Reporter on Monday that Kesha's career woes are entirely of her own making. 

'It was Kesha who chose to file a lawsuit falsely alleging abuse to gain advantage in contract negotiations, and now she must accept the consequences of her improper actions,' the rep told the trade publication.

'As long as she continues to stand by her false claims of abuse against Dr. Luke and remains in breach of her contracts, he will continue to protect his professional and personal reputation, as well as his contractual rights, in a court of law. He looks forward to obtaining judgments in his favor.'

Sony too has weighed in on the matter for the first time, THR reports, telling the judge that it is 'caught in the crossfire.'

In a 2011 deposition, that Dr. Luke previously got a judge to unseal, the singer testified the man behind Miley Cyrus' hit Wrecking Ball and Katy Perry's Roar, never 'roofied' her or coerced her into sex. 

Geragos has said she was terrified of Dr. Luke and his power over her in 2011 and it was only after she started intensive therapy that she had the courage to speak up.

But in a motion for dismissal, The Hollywood Reporter says attorneys for Sony argue that Kesha 'cannot have it both ways.'

'She cannot claim that Gottwald intimidated her into silence, then, as an apparent afterthought, seek to hold Sony and Kemosabe Records liable for failing to act on conduct that she did not report,' the legal documents state.

Meanwhile, the 28-year-old, who performed on stage with Johnny Depp and Alice Cooper as part of their band The Hollywood Vampires at The Roxy in LA on September 16, is watching her 'window of opportunity' shut.

'In the pop music industry, youth and freshness are essential to an artist's success,' her request for an injunction states.

'Kesha will be forced to sit on her hands while the pop music market asks, 'Where is Kesha? What happened to her? Wasn't she supposed to be the next big thing?'' if her motion is denied, the lawyers wrote.

They are requesting a hearing on the motion in New York Superior Court on October 7.
