Did Ruby Rose sign off on racy photos? Actress claims sexy shoot was released against her wishes – but magazine says she agreed all along

Controversy is surrounding Ruby Rose's claims a publication released photos of her without her consent.

The Untitled Magazine was publicly slammed by the Orange Is The New Black star on Instagram for allegedly leaking the sexy shots - one which shows her wearing a very sheer top - from an April shoot, taken by Dani Brubaker for their current Girl Power issue.

But in a statement released to Daily Mail Australia, the arts and lifestyle magazine claim Ruby's representatives knew before they did that images from the embargoed shoot had been mistakenly released to a Canadian news agency by the photographer's agent.

'I would like to point out that the photo shoot with Ruby Rose, which took place on April 13, 2015 and the interview which was completed on June 12, 2015 for the #GirlPower Issue of The Untitled Magazine were with full consent of the actress and her PR team,' a spokesperson confirmed. 

'The Instagram post was the first time we heard any concerns from her or her team regarding the photos that were taken.

'Regarding the leaked photos which Ruby claims we sold to another publication - which is entirely false and her PR team was fully aware of the fact and were the ones to alert us of the issue, which was not the responsibility of The Untitled Magazine but of the photographer's agent.'

The magazine corroborate their claims by releasing previously unseen emails from the 29-year old's team, seemingly expressing their delight at the shoot - and apparent knowledge of the broken embargo. 

In the first, a representative writes: 'Thank you again for this! She looks incredible and it was a really great team. I am thrilled and excited to see the final edit.' 

A further email references the prematurely distributed photos and apparent confusion over their official release date.

‘Also, just wanted to let you know that Dani Brubaker’s rep released some of the UNTITLED images of Ruby prematurely for some Canadian outlet… I had them taken down, but he seemed to believe that there was no agreement or embargo in place,' reads an extract from the email. 

Daily Mail Australia have contacted Ruby's representatives for a response.

Posting on Instagram - where she commands five million followers - the actress implored fans to boycott its current issue for using 'unapproved' images taken eight months previously.

Sharing one of the images, she wrote:  'I am pro "free the nipple" so when I was tagged in this photo by fans I wasn't sure where it came from but I assumed a BTS from a friends shoot or one where we had approved slightly transparency in an image. 

'Imagine my shock to find that @theuntitledmagazine decided to publish images of me after we explained we wouldn't be doing the shoot if I wasn't appropriately covered. The difference with working with a friend and or choosing to use nudity for art / and someone taking the piss and exploiting you is two different things.

She added: Not only is this 8 months old.. The photos unapproved but they also sold photos to other publications. The interview made no sense 8 months on. 

'Please if you are a fan of mine boycott this issue. Or you are buying into greedy, exploitative propaganda. I have plenty of other shoots I'm proud of with professionals coming up its not needed in your collection.' 

The magazine later responded to the actress, writing: 'One of the most important issues today is equality. We would never publish unapproved photos. We do not believe in exploitation!' 

Firing back, Ruby wrote: '"We do not believe in exploitation" however we have seen how upset you are at unapproved published images of you topless in our "girl power magazine" we figure while all the publicity around it. 

'Let's post our "exclusive" "interview" "now!!" Hashtag absolute morons. I'm in shock at how cheap and petty this is. When a simple deletion and apology was all it should have been.'

The Australian actress flew to South Africa earlier this week after landing a role in forthcoming film Resident Evil: The Final Chapter, in which she will appear alongside Milla Jovovich, Ali Larter and Game Of Thrones star Iain Glen.

The Los Angeles based star looked typically casual in a heavily ripped T-shirt that fully displayed her vast array of tattoos during their brief stroll  through the South African city. 

Jogging pants embellished with Chinese yin and yang symbols added to her relaxed ensemble, while a jaunty baseball cap and trainers rounded things off.
