Ben McKenzie confirmed he is expecting a child with his Gotham co-star Morena Baccarin on Friday.

And on the same day her estranged husband reportedly threw some heavy accusations at the two stars of the Fox series.

According to a Friday report from TMZ, Baccarin's estranged husband Austin Chick is claiming in court documents that the actress not only became pregnant while they were still 'working on their marriage' but also that he once found a freshly-showered Ben in his home playing with his son.

At the centre: Her Gotham co-star Ben McKenzie , pictured in New York Thursday night, is mentioned in court douments by Chick as he claims that he arrived home to gather his belongings and found the 37-year-old actor 'had just taken a shower and he was playing with my son.'

The 44-year-old director and 36-year-old Brazilian beauty have been embroiled in a bitter custody battle and Chick claims that their one-year-old son is in a confusing and unhealthy environment.

According to the gossip site, he cites an alleged incident in August (two months after he filed for divorce) where he arrived home to gather his belongings and found Ben 'had just taken a shower and he was playing with my son.'

Chick also claims that Morena told him she was three-and-a-half months pregnant while the legal documents read: 'This places the moment of conception right in the first week of June, 2015, the time she was telling me she wanted to work on our marriage and well before we stopped sharing a bed.'

TMZ also reports Baccarin has claimed they had already discussed separation back in March, as it was written in previous legal documents.

Dailymail.com reached out to both McKenzie and Baccarin's reps for comment.

On Thursday TMZ reported Baccarin won custody of her one-year-old son she had with the estranged husband.

Baccarin's attorney Samantha Spector told TMZ 'Chick will still be able to visit his son once a month for 8 days, but he has to give a 15-day-notice before making a trip.'

Chick will be able to bring his son back to LA every two months for an 8 day visit.

Meanwhile, Ben confirmed the exciting pregnancy news by retweeting a congratulatory message about the pregnancy from his sister.

The 37-year-old actor took to social media on Friday and posted: 'Couldn’t be happier for @ben_mckenzie and @missmorenab. Welcome to the family, ! Also… I’M GONNA BE AN AUNT.'

From his sister Camille, it was the first time either of the stars have confirmed their relationship or the child they are expecting personally.

The news came as Morena was awarded custody of her one-year-old son Julius, whom she had with estranged husband Austin.

The couple's love affair only became public at the beginning of this week, after they were seen getting up close and personal at an Emmy Awards after party.

They met on the set of Gotham - Morena has been starring as Benjamin's on screen love interest in the show.

Ben, who plays Police Commissioner Jim Gordon on the show made his first appearance since the since the news broke of their relationship on Thursday.

He was appearing at the Apple store in Soho, New York

The hunk was spotted wearing a trim black suit with a dark burgundy, patterned tie.

He complemented the suit with a charcoal-colored button down and some distressed but still gleaming wingtips.

As is often the case, Ben was clean shaven, and his hair was gelled and parted to perfection on the right side.

Appearing to be in good spirits, the Southland star even removed is hands from his pockets and briefly stopped to sign a few pieces of memorabilia for Gotham fans.

Meanwhile, several pictures from the set of Gotham displaying Morena's growing bump have surfaced.

The Homeland star can be seen wearing a long white coat, with both arms crossed over her belly.

The camouflaging of her ballooning belly seems to suggest that her pregnancy will not be part of a story line in the show.

Morena joined the Gotham cast towards the end of last year.

People revealed the pair were dating on Monday, and they were seen at a number of events together over the Emmy's weekend.

The pair were spotted holding hands at the Fox party at Vibiana after the award ceremony on Sunday.

Benjamin plays Police Commissioner James Gordon on the show.

Meanwhile Morena, who was nominated for an Emmy for her role as Jessica Brody in Homeland, was introduced at the end of the first season as Dr. Leslie Thompkins.

The pair had actually worked previously together - they revealed to E! both starred on The O.C when Morena had a short stint on the show. However Benjamin could not remember her role.
