It was reported in August that Khloe Kardashian and Kris Jenner were being sued by angry residents who claimed they were 'terrorised' by the loud fireworks display they put on for James Harden's birthday.

But the case has reportedly now been closed after the LA. County District Attorney ruled the mother and daughter duo had 'passive permission' to light up the sky at the Marina Del Rey celebrations hosted in honour of Khloe's basketball player boyfriend.

The Keeping Up With The Kardashians stars are said to have warned the Coast Guard ahead of the August 26 event, who in turn gave the Sheriff's Department a heads up before the festivities kicked off, according to TMZ

Showbiz momager Kris pulled out all the stops to host a huge bash in celebration of Houston Rockets star Harden's 26th birthday, but twelve homeowners in the upmarket marina took umbrage to the noise caused by the all-night event.

The Sheriff's Department is said to have recommended a misdemeanor charge of disturbing the peace, but the D.A. rejected it because the Kardashians had given prior warning and they didn't need a permit since the boat was outside the marina.

However, the disgruntled Marina Del Rey residents are allegedly still intending to go ahead with a small claims lawsuit.

They're seeking damages of $7,500 each, the maximum allowed in California small claims, for the 'emotional distress' they suffered at being woken up at midnight on Wednesday thinking Los Angeles was 'under attack.'

TMZ initially reported that one homeowner's child was upset while another, who has MS, said her condition has worsened since the incident.

The website also reports several celebrities are among those joining together in the lawsuit. 

Since no lawyers are allowed in small claims court, the plaintiffs were originally hoping they will have the opportunity to confront Khloe and Kris face-to-face and let them know how 'rude and supremely sellfish' their actions were.

The 15-minute long fireworks show was launched from a barge just beyond the breakwater and the Kardashians, Jenners and their guests watched from the luxury yacht where they celebrated the Houston Rockets player's 26th birthday.

The NBA star and Khloe, 31, have been dating for around two months.

As the explosive display took off, many residents of Marina Del Rey and others living on LA's west side took to social media to complain about the noise.

Actor Josh Gad, who voices Olaf in the Disney film Frozen, tweeted early Wednesday: 'To whomever planned fireworks at midnight on a Tues thank u. Sincerely parents of 2 children who just woke up thinking we were being shelled.'

Singer Rebecca Black was none-too-pleased as well and she tweeted: 'who on earth in the los angeles areadecided it'd be a good idea to set off FIREWORKS AT MIDNIGHT IM TRYING TO SLEEP.' (sic)

The Sheriff's Department received dozens of noise complaints, according to TMZ.

On Saturday, Khloe told Entertainment Tonight that everything had been done according to the rules.

'I got all the permits,' she told ET when she showed up to support mom Kris at a cookbook signing in Calabsas.

'Someone couldn’t release those fireworks if you didn’t get [one]. The company's licenses would've been revoked, so of course I got everything I had to do to do so. No one would just take that risk,' she said.
