It appears that playing the role of a smart and successful defense lawyer is proving stressful for Katherine Heigl.

The 36-year-old actress was spied enjoying a crafty cigarette while taking a break from filming on her new show doubt on Wednesday.

Katherine was spied puffing away before enjoying a black cherry fizzy drink as she squeezed in some down time between scenes.

And while her on screen character Sadie Ellis normally cuts a smart figure as she negotiates the legal world, by contrast Katherine was sporting a much more casual look.

She had swapped her character's high heels for a pair of Ugg boots as she sat down for her cigarette break on the set in New York.

Katherine has opened up about her smoking habit in the past and in an 2008 interview she branded the habit 'stupid' before adding: '"I started when I was like 22 or 23, and I had my first cigarette at a bar one night, and I was like mmm. ... I'll try this. I can have just one.'

The actress swapped cigarettes for the electronic version in 2011 but she couldn't kick the habit of the real thing.

Earlier in the day Katherine was spotted stripping off her character's smart work attire to change into exercise gear in the middle of the street as the cameras rolled.

After her very public wardrobe change Katherine hopped on a bike and rode off.

Joining Katherine was her co-star Dulé Hill, who was seen checking his phone as he sat in a production chair.

Katherine plays the role of Sadie, a defense lawyer who falls for one of her clients, who may or may not have committed a violent crime in the pilot of the CBS show.

The blonde actress joins the show as a new member of the cast for a remake of the pilot, which was actually shot last year with KaDee Strickland as Sadie Ellis.

After CBS decided to re-shoot the episode, Heigl was cast to replace Strickland.

Dreama Walker, Elliott Gould, Kobi Libii and Laverne Cox also star in the show.
