Halle Berry and Olivier Martinez are divorcing after two years of marriage.

The former couple have one son together, Maceo, aged two. Halle is thought to have filed for divorce first, with Olivier submitting his own petition late on Tuesday, according to TMZ.

In their joint statement the two said: 'It is with a heavy heart that we have come to the decision to divorce. We move forward with love and respect for one another and the shared focus for what is best for our son.'

It was added: 'We wish each other nothing but happiness in life, and we hope that you respect our, and most importantly our children's privacy, as we go through this difficult period.'

Halle and Martinez, both 49, were last seen together on October 17 while at a Halloween event in Sherman Oaks with her daughter Nahla, aged seven, from her relationship with model Gabriel Aubry. Both had their wedding rings on.

The two seemed to be in good spirits as they strolled through a parking lot side by side.

But on Monday the X-Men: The Last Stand beauty looked glum as she headed out on a shopping trip alone.

According to TMZ, the marriage unraveled in the past week after they hit a 'breaking point.'

They had apparently been fighting over a January incident at Los Angeles Internaional Airport, where Martinez hit airport employee Ronaldo Owens with a car seat, pushing him to the ground.

Halle and their son were also there. A $5 million lawsuit was filed in mid-October against both Halle and Martinez for the attack.

This 'exacerbated their conflicts,' it was reported.

'They have a personality difference,' it was also claimed by the site. 'They're just very, very different people. He's a very macho guy, and things just didn't jive.'

As far as the divorce, Halle made the first filing under a pseudonym - using the name Hal Maria - her birth name was Halle Maria Berry, although she goes by Halle.

The documents, published on TMZ, also show that Halle used a fake name for her son Maceo - calling him Mac Martin, and her husband, who she referred to as Oliver Martin.

According to Celebrity Net Worth, Halle has a fortune of some $80million. However she and Martinez both signed a prenuptial agreement prior to their marriage.

'The expectation on Halle's part is for a quick, non-contentious divorce,' said a source.

It later emerged that Martinez had also filed for divorce, having hired well-known divorce attorney Laura Wasser. He asked for joint custody of Maceo in his filing.

Sources also told TMZ that Halle 'is not asking for joint or primary custody, but rather what is in the best interests of the child.'

A source insisted to Peopl e that Halle was 'okay.'

Halle and Martinez wed in July 2013 in a romantic ceremony at the Chateau des Conde in Vallery, France.

Their marriage came six years after Halle told InStyle: 'I will never, never get married again'.

They had met in 2010 on the set of their drama Dark Tide, which wasn't released until 2012.

The two suffered a set back early in their marriage when their plans to relocate to France were brought to a halt by a court ruling that Halle could not take her daughter with her.

Before Frenchman Martinez started a romance with Halle, he spent most of his time in the country.The ruling meant that the family instead made a home in Los Angeles.

The two again made headlines in 2012 when they got into a fight with her ex Aubry during the Thanksgiving holiday.

The male model was dropping daughter Nahla off at Berry's Los Angeles home when he and Martinez got into a verbal then physical fight.

Aubrey claimed the S.W.A.T. actor threatened to kill him. Both men had to go to the hospital for their injuries.

Aubrey was arrested and issued a restraining order as a result of the incident.

Halle has also been in a contentious situation with Aubry when it comes to their financial arrangement. In July she went to court in an attempt to reduce her child support payments.

The Their Eyes Were Watching God star wanted the judge to reduce the child support she's paying Gabriel from $16,000 a month to around $3,000 a month. The case is thought to be ongoing.

In August came the first rumblings that Halle and Martinez were over - as she was not seen wearing her diamond and emerald engagement ring.

But it was claimed by TMZ that she had lost the bauble in January 2014 when at the Acapulco International Film Festival where she received the Silver Jaguar Award.

Halle says the ring either fell off her hand or she left it on a table and someone took it.

This will be Berry's third divorce and Martinez's first.
