The skateboarder, who had been having a coffee with his girlfriend, acted in self-defense, witnesses said.

Santa Ana Police Department Corporal Anthony Bertagna said the 50-year-old died at the scene and they confirmed a skateboard was involved.

The skater initially ran from the store after the confrontation yesterday afternoon but returned shortly afterwards and is cooperating with police. He has not been arrested.

Jocelyn Martinez was inside the Starbucks and told KTLA that the incident was 'really traumatizing'.

She said: 'He just came abruptly into the store, looked at the kid, and said, "Did I stutter?"

'He took a step forward towards the kid as if he were going to attack him, and that's when the kid hit him with the skateboard.'

She added: 'He did what anybody... would do when they feel attacked. They're going to protect themselves.'

A picture taken by a local CBS reporter showed a skateboard sitting on top of a police car outside the cafe.

The Starbucks has been closed while cops investigate the death.
