Phil Collins' third wife Orianne has quietly filed for divorce from her current investment banker husband in Miami, just days after it was revealed that she and the singer are back together, Daily Mail Online has learned exclusively.

According to divorce documents filed on January 19, Orianne, 43, has been 'separated and living apart' from husband Charles Fouad Mejjati, 46, less than eight years after they were married in Geneva, Switzerland.

Besides ending the marriage, Orianne wants to nullify an out-of-court marital settlement agreement that Swiss-born Orianne and Mejjati both signed last spring.

Orianne claims Charles took advantage of her recovery from a botched spinal surgery to talk her into giving him the Miami Beach mansion she bought for the two of them in 2012 for $8.4 million.

According to court documents Mejjati also receives 'one-half interest in the wife's premarital, non-marital residence located in Switzerland with a very substantial value.' This residence may have been given to her by Collins.

A source close to Collins said Orianne, her two sons with Phil and her 5-year-old son with the Moroccan-born Mejjati have been secretly living with Phil in Miami Beach since last summer, six years after paying her $36 million in their divorce - at the time Britain's biggest ever settlement.

The former Genesis drummer and frontman and solo singer of hits like Against All Odds and In The Air Tonight bought Jennifer Lopez's old house in Miami Beach last June for $33 million.

The source told Daily Mail Online that Orianne moved in with Phil days after he bought the house where JLo broke up with then-longtime love Ben Affleck in 2004.

Mejjati was served the divorce papers at the home he once shared with Orianne, about a mile south from Collins' house.

'The divorce filing is really designed to get Charles off her and Phil's back,' the source said.

In addition to voiding the marriage, the complaint's aim is also to nullify an out-of-court marital settlement agreement that Swiss-born Orianne and Charles both signed last spring.

Orianne says she doesn't remember signing over the property, and now she wants the home in the swanky Sunset Isles part of Miami Beach to be returned to its status as marital property owned jointly.

Neither Mejjati nor Orianne's lawyer, Florida divorce law guru John Christiansen, returned request for comment from Daily Mail Online.

Mejjati has yet to hire a lawyer and respond to the divorce filing, according to court records.

One thing about the filing is clear: Orianne is uneasy about the marital settlement agreement she signed in May 2015 that automatically transferred ownership of the marital home to Mejjati.

'The husband threatened that he would disclose and make public allegations about the wife,' the complaint reads, 'that would cause the wife great personal, professional and social embarrassment, humiliation and upset and would, the husband threatened, also result in the wife losing custody of her child.'

Mejjati, who claims to be a venture capitalist, allegedly threatened to take their boy, Andrea, back to Switzerland, according to the court papers.

The documents also explain how Charles allegedly threatened there would be 'hell to pay' if she didn't sign.

The complaint claims Orianne wasn't really herself at the time because of her reliance on painkilling medication, according to the court file.

'Throughout the entire time of the husband's threats to and bullying of the wife . . . , the wife was attempting to recover from her spinal surgery, and was in constant and extreme pain and taking pain killers prescribed to the wife by her physicians to help her cope with the physical pain she was enduring each day,' it is claimed in court documents.

As a result, the marital settlement is 'unfair on its face, and is unconscionable,' attorney Christiansen wrote, because 'the husband receives the majority of the marital assets and also receives one-half interest in the wife's premarital, non-marital residence located in Switzerland with a very substantial value.'

Orianne does own a sprawling estate in Begnins, near Nyon, that's been on the market for $62 million, according to newspapers in Switzerland.

Miami Beach, property records show Orianne bought the Miami home in question in May, 2012 for $8.4 million. It has seven bedrooms and eight bathrooms over nearly 10,000 square feet of living space.

On May 21, 2015, records show, Orianne signed the deed over to Mejjati for a grand total of $10 before a notary public in Miami Beach, according to Miami-Dade County property records.

Yet, Orianne doesn't remember signing a deed. 'She has no recollection of ever seeing before it was recorded in the Miami-Dade County public record, transferring to the husband the wife's interest in and to the marital residence,' according to the divorce filing.

On Orianne's behalf, lawyer Christiansen wrote the deed is invalid because it was obtained 'through fraud and deceit.'

With her petition, Orianne asked the family court to dissolve her marriage to Mejjati, determine a time sharing plan and financial support for the boy, distribute the assets and liabilities of the marriage, nullify last year's divorce settlement and return to Orianne half the ownership of the Miami Beach house.

While Mejjati remains largely unknown in South Florida, Phil and Orianne have been visible, often together, at various society functions.

In 2000, Phil and Orianne co-founded the Little Dreams Foundation to help disadvantaged children to train in music, arts and sports, and both have attended bi-yearly fundraisers for the charity and other area non-profits.

The foundation's next South Florida fundraiser is scheduled to take place March 11 in Miami Beach. 

He married Orianne in 1999 in a lavish half-million dollar ceremony attended by the likes of Elton John and Eric Clapton. They had two sons, Matthew and Nicholas but separated in 2006.

When Orianne and the boys moved to Miami, Collins said in interviews it almost killed him. He has remained single.

'I went through a few bits of darkness, drinking too much,' he said. 'I killed my hours watching TV and drinking, and it almost killed me.'

WHAT IS BROWN-SEQUARD SYNDROME?

Brown-Séquard syndrome is a rare spinal disorder hat results from an injury to one side of the spinal cord.

A lesion occurs because the spinal cord has been damaged rather than being completely severed. 

Symptoms include:

  • Paralysis on the side where damage has occurred 
  • Lessened sensation on the other side
  • There is paralysis of the voluntary muscles (those that are controlled at will, such as arms and legs) below the level of the lesion 
  • Loss of sensation at the level of the lesion 

Symptoms of Brown-Séquard syndrome usually appear after an affected individual experiences a trauma to the neck or back. 

Sensations that tend to be lost first are  pain and temperature - often below the area of the trauma.

There may also be loss of bladder and bowel control.

Paralysis tends to occur on the same side as the injury - and may be permanent if diagnosis is delayed.

But people with the condition generally have a good chance of recovering a large measure of function. 

More than 90 per cent of those affected recover bladder and bowel control, and the ability to walk.

The Swiss translator, philanthropist and jewelery designer was left using a wheelchair after she was partially paralyzed due to complications with a 2014 surgery to treat a slipped disc in her neck, but she is now walking again after rehabilitation.

Speaking to Billboard, he said: 'I'm back with my third wife - I haven't really talked about it. We've been together for a while, and nobody's noticed.' 

Collins moved back to America last year from his home in Switzerland to be closer to the couple's two sons - Matthew, 14, and Nicholas, 10 - after problems with alcoholism, which stemmed from the divorce.

In February 2015, she filed a criminal complaint following the surgery in a hospital in Switzerland. 

Speaking to Swiss website, Le Matin at the time, she said: 'On December 16 I had an operation for a slipped disc in my neck.

'Afterwards, I woke up paralyzed. I had absolutely no feeling in my whole body, from my head to the tips of my toes.'

It all began when Orianne, who has a black belt in mixed martial arts, skis, and played tennis and golf, had persistent pain in her shoulder and neck.

She left Miami for Switzerland because of the 'standard of care' offered in the country.

'We have the best doctors here,' she added. 'It was the best solution. I thought I was in good hands.'

The disc was removed and replaced with a prosthetic and three days later she was told she could go home. But not everything went to plan and she awoke unable to feel anything and started to panic.

An MRI scan revealed she had Brown-Sequard syndrome - a rare spinal disorder that results from an injury to one side of the spinal cord. 

However, following rehabilitation, she is now walking again with the help of a cane, and has been spotted on several occasions recently on her feet. 

Meanwhile, in a recent interview with The Times, the In The Air Tonight singer opened up about the effect the split from Orianne had on him, and how it led to him drowning his sorrows by hitting the bottle.

He confessed: 'There was a massive hole in my life, which I filled with a lot of drinking.'

He would start drinking wine at 11, then move on to vodka, he said. 

Such was the destructive path he was on that a Swiss doctor asked if he had his 'papers in order'.

While it was the absence of his family that put him on his downward spiral, it was the thought of his worried sons which prompted him to conquer his demons.

He said: 'With the drinking I saw that my kids got worried. I was taking pills for one thing or another, then I'd fall down the stairs. Now I've given up and family life is so much better.'
