Man is cleared of raping his ex-girlfriend, 17, because she was into bondage and 'he had no way of knowing she was genuinely saying no', Spanish judge rules

  • Man, 21, frequently engaged in domination and sadomasochism with girl
  • They broke up but reunited weeks later and started touching each other
  • She asked him to stop, but he ignored her and had intercourse with her
  •  Judge acquitted him, saying defendant 'thought this time was no different'

A man has been cleared of raping his ex-girlfriend because she liked bondage and it wasn't clear to him that no meant no, a judge has ruled.

The defendant, 21, frequently engaged in rough sex with the 17-year-old girl while they were dating including domination and sadomasochism, a court in Alicante, Spain, heard.

The court ruling said: 'Their sexual relations had involved insults, harassment, force and some level of violence that was accepted by both parties.'

Their six-month relationship ended in August 2014 when she caught him with another woman.

But they connected again on Facebook two months later.

He invited her round to his house where they smoked cannabis and began to touch each other, it was reported by The Local

She asked him to stop, but he ignored her and 'held her by her wrists, pulled off her tights' and had intercourse with her.

The teenager suffered bruising and depression after the incident, she said.

The judge acquitted the man of rape, saying that the couple's rough sexual relations were so common 'he thought this time was no different.'
