'She is a f***ing b***h': Sumner Redstone, 92, unleashes multiple vulgar tirades about ex-girlfriend Manuela Herzer in shocking deposition - and is asked to fix his dentures TWICE during questioning

Sumner Redstone did not hold back during a deposition in his mental competency case released on Friday, with the 92-year-old uttering a string of expletives to describe ex-girlfriend ManuelaHerzer.

The first question asked of Redstone during his taped deposition is; 'Who is Manuela Herzer?'

An interpreter, on hand to help Redstone, jumps in at this point to ask that the question be asked 'slowly,' but is cut off by the billionaire mogul as he responds; 'She is - Manuela is a f***ing b****.'

Redstone goes on to repeat this statement three more times over the course of the deposition.

Parts of Redstone's 18-minute deposition, which was conducted at his Beverly Park home on Thursday, were presented at the start of the trial, meant to settle questions about his mental state.

His testimony was difficult to understand at times due to his speech impediment and a problem with his dentures, which had to be adjusted twice during the brief deposition.

Redstone did not appear in court on Friday, but his daughter Shari and grandson Brandon were present as was Herzer.

Herzer filed her lawsuit in November, one month after she was suddenly banned from Redstone's Beverly Park mansion and removed as his primary caretaker.

She was to receive '$50 million and Redstone’s Beverly Park home, worth roughly $20 million' upon his death according to a court filing earlier this month in the Superior Court of the State of California.

That money would come on top of the $70 million in cash and assets Redstone's daughter Shari said her father gave to Herzer since just 2009 while she lived near his home.

The money from the will has now been directed to Redstone's charitable foundations. 

A deal negotiated between lawyers for both sides that would have paid Herzer a reported $30million to drop her case fell apart at the eleventh hour for unknown reasons. 

Redstone could not recall exactly how long Manuela lived with him in his deposition, or the years they were together, but he was able to recall that he kicked her out of his home in October 2015. 

That answer came after much back and forth between Herzer's lawyer and Redstone's interpreter, with both parties wanting to be certain that Redstone had indeed said 'October 2015.'

It was also during this exchange that the interpreter requests that someone 'adjust' Redstone's dentures.

Redstone is then asked if Herzer helped him with his health care when she lived in the home, and admits that she did in fact do so while staying at his residence.

When asked however what she did to help him, Redstone responded by saying; Manuela is a f***ing b****.' 

Redstone then has problems speaking it seems and a board is brought out so he can point to letters while Herzer's lawyer repeats the question multiple times.

After spending three minutes trying to get an answer to the question to no avail Herzer's lawyer agrees to move on with the questioning. 

Herzer's lawyer also skips over the next question when he gets no response after asking Redstone what his birth name was, with the mogul having convinced his father when he was a teenager that the family should change their last name from 'Rothstein' to 'Redstone.'

Moving on he shows Redstone a photo of himself with Herzer, asking when it was taken.

Redstone responds to this by saying; 'Who cares.' 

Upon further questioning he is able to say that the picture was taken at Paramount while he and Herzer were dating. He also admits that he was in love with Herzer at the time. 

Redstone then answers in the affirmative when asked if Herzer stole money from him, but is unable to give an amount when pressed for detail.

He also answers the next question in the affirmative when asked; 'Did you ever say Manuela was the love of your life?' 

For his final question, Herzer's lawyer asks Redstone if he said anything to his ex as she was leaving his home or gave her a reason as to why he was kicking her out.

Redstone responds to this by saying 'no,' and when asked why tells the attorney; 'Because she's a f***ing b****.'

Gabrielle Vidal, a member of Redstone's legal team, had far better luck getting answers out of the nonagenarian while questioning him during the deposition.

When asked why he kicked out Herzer, Redstone tells her; 'She lied to me.'

Vidal then asks what Herzer lied about and Redstone replies; 'Terry's availability and Sydney's letter.' 

The letter he is referring to is one Redstone has claimed was hand delivered to Herzer by his ex Sydney Holland apologizing to him and professing her love after he kicked her out of his home last September.

The Terry he is referring to is Terry Holbrook, one of his female companions.

Herzer has said both these claims are false. 

Video then asks Redstone how he feels about Herzer now, to which he responds; 'I hate her. She's a f***ing b****.'

The next line of questions are about Redstone's family, and he says he is happy to be seeing them again and wants his daughter Shari to be in charge of making his health decisions.

Then, after fixing his dentures for a second time, Restone is asked what he wants out of the trial.

'I want Manuela out of my life,' says Redstone. 

Redstone's attorney Robert Klieger said in his opening statement on Friday however that Redstone was very much mentally competent when he demanded Herzer be removed from his home.

Klieger said that it was Herzer's repeated lies that forced Redstone to cut her out of his life.

'Mr. Redstone does not tolerate lies,' said Klieger. 

Klieger also said that Herzer 'tricked Mr. Redstone, and later told the court; 'Everything in this case is a soap opera.'

He also that he would make it clear over the course of the case that Redstone was very much aware of what he was doing when he changed his health care directive in October, taking control away from Herzer and giving power over all issues related to his health to Philippe Dauman, the CEO and Chair of Viacom. 

Herzer's lawyer Pierce O’Donnell told a much different story however, focusing much of his opening on Redstone's ailing health and painting Herzer as a selfless victim who was just trying to do what was right for a man she cared about for so many years.

'Lost to us is the titan of the media world,' said O'Donnell

'He was unable to answer even the simplest questions,' he added when speaking about his taped deposition, and said he left Redstone's home that day 'profoundly disturbed' over the language he used to describe Herzer.

As O'Donnell told it, Redstone is a man with mental competency issues, his 'mind feeble and his body ravaged by age.'

It was in this state O'Donnell said that some around Redstone began to take advantage of the man, behaving in 'unethical and immoral' ways'

'The motive was to get rid of Manuela by any means because she was a barrier to [Redstone's daughter] Sheri taking control of his health and his media empire,' said O'Donnell.

'The evidence will show Sumner asked Manuela to protect him.'

He ended by saying the person who was truly unfit to be Redstone's health care agent was his daughter Shari.

O'Donnell's first witness confirmed almost everything he said in his opening statement.

Dr. Stephen L. Read, a geriatric psychiatrist hired by Herzer, was the first medical expert to take the stand in the trial.

He testified under oath that in his medical opinion Redstone has dementia and suffers from possible delusions. He also said he was not of sound mind when he made the decision to kick Herzer out of his home and remove her from his health care directive in October.

'He does have major neurological problems,' said Dr. Read of Redstone.

Dr. Read went on to call Redstone 'severely impaired' saying he was a 'thin shadow' of his former self.

'He did not have the requisite mental capacity to understand the changing of his health care directive of October 16, 2015,' said Dr. Read.

He also spoke about Redstone's behavior and his 'propensity to erupt in anger' at any given moment.

'When anger takes over reasoning is ablated. That removes his inability to think about this, access memory, consider alternatives to do the things that are required to make an informed decision,' said Dr. Read.

He went on to say that removing Herzer from his life made matters worse and had 'potentially terrible effects' on Redstone.

He then detailed his January 29 examination of Redstone, which was granted by the court at Herzer's request. 

During that session Dr. Read said that Redstone repeatedly stated that Herzer stole $40million from him and was confused as to the amount of money he had previously planned to leave her in a trust.

Dr. Read also spoke about how difficult it was for Redstone to communicate and how hard it was to understand him when he did speak. 

He also spoke about Redstone's physical abilities, saying; 'Mr. Redstone can’t hold a pencil. He’s completely disabled. For the most basic acts of a human’s life, he can’t do them himself.'

Herzer filed paperwork in the Superior Court of the State of California in February after the 92-year-old was evaluated by Dr. Stephen L. Read, who stated that Redstone is not capable of acting in his 'own rational self-interest' and 'lacked the mental capacity to make a change in his appointed health care agent' at the time he kicked Herzer out of his home.

Herzer, 52, also provided a timeline of her relationship with Redstone, from when they first met and began dating in 1999 through the day he stepped down as head of Viacom earlier this month.

Included in that timeline are two visits from Heidi MacKinney, a woman who Redstone had sex with while a nurse stood in the room and coached him according to Herzer.

'During Heidi MacKinney's visits with Mr. Redstone, Nurse [Jeremy] Jagiello was in the room and would tell her what sex acts to perform; that sometimes he would tell Mr. Redstone that he had ejaculated when in fact he had not, and that Mr. Redstone believed him,' Herzer said in her court filing.

This incident was revealed by Herzer to support her claim that Redstone 'is the victim of undue influence, fraud and manipulation.'

According to the timeline, MacKinney came to visit Redstone around October 3 and 'testified that when she offered to be intimate with him, Mr. Redstone appeared uncharacteristically "non-responsive and vacant," and that she vowed not to return.'

MacKinney did however return according to Herzer on October 10, but 'cuts the visit short after observing that Mr. Redstone appeared to be unaware of her presence, much less able to communicate with her.'

Redstone was 'barely a shadow of the man I had once known,' according to MacKinney.

The timeline also details Redstone's tempestuous relationship with his daughter Shari, claiming that in late 2014 he offered his daughter '$1billion to surrender her stake in National Amusements Inc.,' an offer she declined.

Then, just this past September, the filing claims that Redstone had Shari and her son Tyler ordered out of his home.

The April issue of Vanity Fair also revealed a few of the claims being made by Herzer in her filing.

One of these allegations details the media magnate's decision to ignore the advice of medical professionals when they urged him to limit his sexual activity to just once a week so he could have enough energy to swallow on his own.

If Redstone could pass his swallowing test then the feeding tube in his throat could be removed Herzer claims he was told in her filing, and as a result he would be able to enjoy his favorite food once again - steak.

'Sumner is obsessed with eating steak and would attempt to eat one if it were placed in front of him, not seeming to recall or understand why he cannot do so,' wrote Herzer.

Redstone refused to take this advice however according to Herzer, choosing sex over the ability to eat solid food.

Then there is the report of a tape featuring a 'butt naked' Redstone, which comes not from Herzer or her filing but rather multiple sources who spoke to Vanity Fair

The alleged tape was filmed at Redstone's $20million Beverly Park mansion according to sources and shows the nonagenarian sitting naked in a chair while watching two women kiss.

It was allegedly filmed by one of his 'handlers.'

Redstone also reportedly heaves his body over the chair's armrest at one point in the alleged tape, drawing the attention of the two women.

An individual who was told about the contents of the tape said; 'He’s just sitting there, kind of like comatose.'

Another person with knowledge about what was filmed said that the thought of the alleged tape 'ruined my sex life for a couple of weeks.'

Redstone stepped down from his role as chairman at both CBS and Viacom in February, becoming chairman emeritus at both and handing over the reins to Les Moonves and Philippe Dauman respectively.

Herzer was banned from the billionaire media mogul's Beverly Park mansion in October for reasons that remain unclear.

She began dating Redstone - who is worth an estimated $5.2billion - in 1999, and remained a close friend and confidante after the two split, moving to a house just down the street from him.

Six weeks prior, Redstone had kicked out his live-in lover of four years Sydney Holland, 44, after learning she was having an affair.

At the same, Redstone appeared to be getting closer to his family, with whom he has long had a tumultuous relationship.

Herzer's teenage daughter Kathrine currently stars on the show Madam Secretary - which airs on CBS.

The Hollywood Reporter spoke with Holland's attorney Brad Rose at the time who said: 'Sydney Holland and Sumner Redstone have had a caring and wonderful relationship for over five years.

'While Sydney would have liked the relationship to have lasted for many more years to come, relationships are dynamic and ever-changing and for a whole host of circumstances, the couple has parted ways.'

He then added: 'While rumor and innuendo will undoubtedly surface as a consequence of this breakup, at this time, Ms. Holland is very upset and has no further comment.'

Shortly after the split, 49-year-old actor George Pilgrim came forward saying he had been having a relationship with Holland in an interview with Vanity Fair.

He claimed she would fly down to where he lived in Arizona and spend the day with him, but always fly back on her private jet and never spent the night.

Redstone was last seen in public at a birthday party thrown for him in May by Holland and Herzer at a restaurant in Bel Air.

Some in the industry had reportedly grown concerned over the past few years about the power Holland and Herzer had over the aging billionaire, especially after Redstone's former driver wrote a piece for The Hollywood Reporter last May detailing his work duties.

Tim Jensen claimed that Holland had him withdraw over $1million while he worked for Redstone between 2011 and 2012 which he then gave to a handful of women.

In April 2011, he also claimed he took Redstone and Holland to dinner and learned the businessman had set up a trust fund in her name.

'It had become pretty clear... that Holland had aligned herself with Redstone and was reaping significant financial benefits,' he wrote.

'I had heard various rumors about Holland from people on staff and learned that she had been known as Sydney Stanger and was the co-founder of The Inner Circle, a VIP social club that advertised matchmaking services.'

He added: 'Within my first year, I witnessed how Holland utilized Redstone's wealth. She asked him to donate money to several charities in her name.

Redstone also said he was financing her Rich Hippie Productions, which Holland said would be a full-scale film and production company.

'By the end of 2011, Holland appeared to me to have taken charge of Redstone's personal life, and many of us working at the house felt that she had gained significant decision-making power.

'My days at work would start with text messages or phone calls with instructions - not from Redstone or a staff member but from Holland - as to what my responsibilities for the day would be. I was still driving Redstone to events and dinners in the Paramount car.

'But now I was spending much more time doing things at Holland's direction that, in my experience, are not the usual tasks of a studio executive driver's job.'

Jensen said the relationship between him and Holland began to sour and he was let go in 2012, but refused to accept the $36,000 he would be paid to sign a non-disclosure agreement.

Around the same time Jensen detailed his time working for Redstone, the New York Post claimed to have found an email between Holland and a former attorney in which she was allegedly told she was 'good for between $9million and $10million' because of her relationship with Redstone.

Herzer said in her Vanity Fair interview that she would be shocked if Holland was not in Redstone's will.

'I mean, five years of your life with a man every single day like that. I have to tell you, would she be there if he wasn’t doing something for her? Probably not. But does she love him? Absolutely. I don’t have a doubt in my mind,' said Herzer.

'For her it’s a job almost, it’s a job.

'I know it’s hard to believe, because I’ll tell you why. Because up to now she’s had a great life. She has a great life. She lives in a beautiful mansion. She has beautiful things.'

There is also the question of Alexandra Red, the baby girl Holland adopted while she was dating Redstone.

Though at the time a Viacom rep said that Redstone had nothing to do with the child, a source told the New York Daily News; 'They cut the last name on purpose so the media doesn’t find out. They are not telling anyone.'

Redstone was married twice before his relationship to Holland, first to Phyllis Gloria Raphael from 1944 to 1999 and later to Paula Fortunato from 2002 to 2009.

Fortunato, who is 39 years younger than Redstone, received $5million - $1million for every year the couple was married.

His first wife meanwhile walked away with an undisclosed amount of money while also securing stocks for her grandchildren and that the couple's daughter Shari would assume her father's business role upon his death according to the Los Angeles Times
