Dr. Luke gives OK for Kesha to perform at Billboard Awards after she promises not to mention the ongoing lawsuit during her set

Dr. Luke and his record label say they are giving Kesha the OK to perform at Sunday's Billboard Music Awards in Las Vegas.

Kemosabe Records said on Thursday that it had reversed an earlier decision after Kesha reassured the label that she wasn't going to highlight the ongoing lawsuit onstage.

Her set was initially canceled after TMZ reported Kesha planned a 'statement performance' that 'might even include images' of Dr Luke - though she wrote on Instagram that wasn't true.

After the decision was overturned, the 29-year-old singer was seen looking relaxed, walking barefoot around a street near her home in Los Angeles and chatting on the phone.

The dispute stems from the 29-year-old singer's unsuccessful attempt to scrap her six-album recording contract with Sony Music earlier this year, accusing Dr. Luke of sexual assault in 2014.

The legal case, which is ongoing, sparked the #FreeKesha campaign on social media and earned support from artists such as Taylor Swift, Adele and Lady Gaga.

Kesha will perform Bob Dylan's It Ain't Me Babe at the awards ceremony. 

On Thursday Kemosabe Records said in a statement: 'Kesha's performance on the Billboard Music Awards was always approved, in good faith. 

'Approval was only suspended when Kemosabe learned Kesha was to use the performance as a platform to discuss the litigation.

'Now that Kemosabe has obtained assurances, that it is relying upon, from Kesha, her representatives and Dick Clark Productions that neither Kesha nor her supporters will use the performance as such a platform, the approval has been restored.'

Kesha celebrated the news with an Instagram post that read: 'You and I are more than friends... We're like a really small gang.'

She added the caption: 'Good work animals. Looks like our voices can be heard after all.'

It comes two days after Kesha posted on Instagram, insisting her performance would not include any mention of Dr Luke. 

'I was very excited to perform a tribute to Bob Dylan by singing a cover of 'It ain't me, babe' at the Billboard awards this year,' she wrote beside a photo of herself playing guitar.

'I'm very sad and sorry to say I won't be allowed to do this,' she added.

'I just wanted to make very clear that this performance was about me honoring one of my favorite songwriters of all time and has never had anything at all to do with Dr. Luke.

'I was never going to use a picture of him, speak of him or allude to my legal situation in any way. I simply wanted to sing a song I love to honor an artist I have always looked up to.'

And the True Colors singer added: 'Thank u all for the continued support.' 

In a separate statement released on Thursday, the Billboard Awards and Dick Clark Productions said: 'We are pleased that Kesha and Kemosabe Records have reached an agreement.

'(We) very much look forward to having Kesha perform on the Billboard Music Awards.' 

Dr. Luke has served as Kesha's mentor for several years and signed her to his label. 

They wrote hits together for Kesha and other acts. 

They have been at odds since she accused of him of drugging, sexually abusing and emotionally tormenting her.

The Billboard Music Awards will air on ABC from the T-Mobile Arena in Las Vegas at 8pm EDT.
