The devastated family of a 21-year-old woman who fell to her death from her boyfriend's Gold Coast apartment after he bombarded and belittled her in 1439 text messages are fighting a new battle to stop him erasing his sentence.
Dan Shearin, a 42-year-old cruise ship entertainer, was convicted of harassing
Shearin was the first boyfriend of the pretty young cheerleader and aspiring singer, who was made more vulnerable by eyesight so poor she was legally blind.

Shearin was sentenced in October last year to a minimum of two months and a maximum of six months in prison for using his mobile phone to menace or harass Robinson, who was just over half his age when she died in January 2013.
He is appealing the conviction in the Queensland District Court and was granted bail because the court was unable to schedule a hearing soon after his sentence was handed down.
In all, he has served just ten days behind bars.
Shearin is asking the court to have the remainder of his sentence deleted. The case is due to be heard in June.
Daily Mail Australia can also reveal he has appeared in the office of Queensland travel company Cruise Holidays GC.
Shearin is featured in photographs at an event in the Cruise Holidays office wearing the same logo-embossed uniform as other staff. His photograph and a biography titled Dan 'The Cruise Man' also appeared on the 'About Us' page of the Cruise Holidays
The photographs, along with the biography, were removed after Daily Mail Australia contacted Cruise Holidays GC about them.
Cruise Holidays GC owner and managing director, Nicholas Rone, told Daily Mail Australia in an email response to questions about Shearin: 'Mr Shearin does not work for this organisation.'
He said Mr Shearin's case was currently before the courts and it
Janine Mackney, Robinson's aunt, told Daily Mail Australia the family believed Shearin should be made to serve every minute of his sentence on the harassment charge.
She also said the family was 'extremely concerned' Shearin might once again be working in the cruise industry.
'It's not just
Friends of Breeana's have told Daily Mail Australia she became interested in Shearin because of her hopes to become a dancer, and that he had promised to help her get work on cruise ships.
Back on the scene: Hours after Dan Shearin was released from prison last November, he was reportedly back partying and was photographed (above) arriving at his Gold Coast home in the riverside suburb of Nerang while he appeals his prison sentence in June for using his phone to menace or harass his girlfriend who died at his apartment block
Daily Mail Australia has previously revealed that other young women have made complaints about Shearin's harassing and controlling behaviour.
Last October, the convicting magistrate called Shearin a
Shearin was pictured on the Cruise Holidays GC Facebook page smiling at a recent guest evening.
He features in several photographs with the post, 'A big thanks you to all our wonderful APT River Cruise Evening Guests who joined us last night - Fabulous night, lots of great food, drink & fun ... Now we all just have to get through the day after all those sausages and maybe a few too many wheat beers & Gluhweins!!
Soon after getting out of prison, Shearin posted a message on his Facebook page.
'Life moves on and I am strong enough to endure whatever people want to throw at me,' Shearin wrote.
'To any friends commenting on this post, please be aware you may be targeted by the band of online trolls wanting their 15 seconds of fame along with their paid interview with A Current Affair,' he continued.
Dan Shearin was back on his favourite medium, Facebook, and calling his critics 'internet trolls' within hours of being relesed from prison and is now appears to be working in the cruise industry, which the family of his dead girlfriend Breeana Robinson says they find 'very concerning'
The self described ultimate cruise ship entertainer (pictured, above in a stage show) was given notice by luxury resort company Wyndham last year but has now turned up at and event held by Queensland travel company Cruis Holidays GC on the Gold Coast
Shearin was released from prison after pleading that he would not be able to go to work and if he lost his job, he would not be able to pay rent on the Gold Coast house (where he is pictured, above) he shared with his two pet dogs
Within hours of release last year, Dan Shearin had posted the message (above) on Facebook, calling his critics 'media trolls' and saying they just want to give paid interviews to the Nine Network's A Current Affair
Ms Mackney and Ms Robinson's mother, Elaine Robinson, spoke with the Nine Network last October about their grief and sense of loss following Breeana's death.
Ms Mackney said the family was 'not paid one cent' for the interviews.
Among the documents in Shearin's bail application, obtained by Daily Mail Australia, is a letter saying if he wasn't granted bail he would not be able to go to work and if he lost his job, he would not be able to pay rent on the house where he lives with his two dogs.
Shearin was employed at the time by Wyndham Vacation Resorts Asia Pacific, a luxury holiday property company, as a travel consultant.
Facebook fiend: A former girlfriend of Shearin's, Trish, says that Shearin was 'Facebook and text message obsessed' and that he habitually set up Facebook pages in fake names to make it appear people were supporting him
Breeana Robinson, pictured left in both images, was bombarded with 1439 text messages by ex-boyfriend Dan Shearin in the month before she died
A letter on the court file from Wyndham's senior vice president of human rescources, Bruce Harkness, warns Shearin he might lose his job if he was convicted.
Wyndham writes to Shearin that he would be 'unable to fulfil your contractual obligations ... while you are incarcerated' and that the 'conviction of the crime comprosmises the integrity of the business and your ability to perform your job duties and is classed as serious misconduct under our business principles'.
Mr Harkness refused to comment to Daily Mail Australia about whether it had terminated Shearin's employment.
A former girlfriend of Shearin's, Trish, who has come out in support of Breeana's family, says Shearin was 'Facebook and text message obsessed' and that he habitually set up Facebook pages in fake names to make it appear people were supporting him.
Trish said she went out with Shearin for six months in the early part of this decade and that he had violent mood swings that made her fear for her safety.
'He was a nasty belittler and controller and one occasion when I'd decided to leave his apartment he ripped my keys from my hand, cutting me, and locked the door,' she told Daily Mail Australia.
'He told me I was a slut and a bitch and I had cheated on him.'
Obsessed: One of the girls who spent six months as the girlfriend of Dan Shearin (pictured, centre in a travel stage show musical) said the entertainer was obsessed with the size of his genitals and constantly asked her if he was 'the biggest'
Dan Shearin was partying after he left jail and reportedly held a party in the apartment from which his grilfriend Ms Robinson'fell in January, 2013
Trish said Shearin was obsessed with girls being in love with him and the size of his penis.
'He'd send photos of his private parts and you had to tell him he was the biggest. That was a very touchy subject for him.'
Trish said she broke up with Shearin after they had holidayed in Hawaii with his mother and stepfather, who were 'beautiful people'.
Tragic: Pretty blonde 21-year-old Breeana Robinson had ambitions to be a dancer and Dan Shearing promised to help her make her way
'He showed a good face in front of them, but behind closed doors it was a different story.'
Trish said she had taken a case to Queensland Police against Shearin for harrassing text messages and emails, but she says she was told it was not pursued because she lived across the border in northern NSW.
In October last year, Shearin pleaded guilty to using a carriage service to menace or harass earlier that same month.
Southport Court was told Ms Robinson had received Shearin's final text message, in the apartment where she she had been living with him for a little over a month, just ten minutes before her death.
Ms Robinson fell from the balcony at 10.35pm on January 29, 2013 after she had returned from cheerleading practice.

The athletic, but slight, young woman - who had had dreams of becoming a dancer, despite having been legally blind since a young age - fell several hundred metres on to the street level awning above the shops and restaurants at the base of the building. .
In the 38 days Ms Robinson was with Shearin, he frequently used text messages to turn on her.
The court heard evidence that in the text message sent to Ms Robinson ten minutes before she died, Shearin said: 'You're more interested in TV, food and everything else but your partner. That's why everything's ruined. Your priorities are f***ed up'.

In another text message sent to Breanna that was heard in court, Shearin said: 'You're a complete f***ing moron. I don't want a stupid, dumb c***'.
Shearin, who describes himself on Google Plus as 'Australia's premiere cruise ship vocalist/author & cruise ship specialist' was Ms Robinson's first boyfriend.
He has called girls 'bitches' and a 'psycho' on one of his Facebook pages.

Friends of Ms Robinson told Daily Mail Australia how the 'lovely young woman' who had struggled at school because of a chronic astigmatism called 'cat's eye', would have done anything to become a dancer.
'She believed Dan would help her achieve that goal,' the friend said, on condition of anonymity.
'She was the sweetest, kindest person, unaffected and always apologising,' the friend said.

Ms Robinson, who was unable to drive a car because of her sight problems, fought to be independent, and had travelled overseas to see the Moulin Rouge in Paris.
'She idolised Gold Coast dancer Anthony Ikin,' the friend said.
'She knew she couldn't be a Moulin Rouge dancer, but she hoped to dance professionally and that's how she and [Dan Shearin] met.
'He promised to help her get work on cruise ships.'
