  • She says that after she learned she was filmed she spiraled into a cycle of depression, anxiety, self-harm, drink and drug abuse
  • Now he is lodging court papers against her parents 'B.T.' and 'J.T.' claiming it was their parenting which harmed their daughter
  • Court papers say: 'Jane Doe's ability to engage in harmful behaviors was the direct result of B.T. ... and J.T.'s failure to properly supervise Jane Doe.'

Jared Fogle, the disgraced Subway pitchman who was convicted of a string of child sex offenses, is suing one of his victim's parents, DailyMail.com can reveal.

Fogle, currently detained at a federal prison in Colorado, has lodged court documents blaming the girl's parents for a cycle of despair, self-harm and drink and drug abuse which she says was the result of his abuse.

In court documents obtained by DailyMail, Fogle claims that her parents, named only as B.T. and J.T. are responsible for what happened to her - and not him.

The girl, Jane Doe, lodged a compensation claim against millionaire Fogle earlier this year.

In court papers she told how she learned that Fogle's business partner, Russell Taylor, had filmed her with secret cameras bathing and undressing at his house, to which she was a regular visitor between March 2011 and January 2015.

Fogle, she said, had solicited the videos from Taylor, and she was one of the series of minors Taylor captured on camera for her perverted business partner's illegal pleasure.

Fogle initially defended the case by saying the girl, whose age has not been disclosed but who was a minor when she was filmed, had received $100,000 in compensation as part of the plea deal which resulted in him being jailed.

But now he has delivered a fresh set of papers to federal court in Indianapolis - with an extraordinary series of allegations leveled at her parents.

Fogle seeks to absolve himself of all blame by claiming that the girl had been been neglected by her parents and forced to watch them fight in front of her.

The parents have not responded to the legal case, and a judge will have to approve a full-scale court action.

In a series of allegations about the parents, he claims that the end of their marriage was followed by custody and parenting arrangements which 'caused unnecessary stress, anxiety, and trauma for Jane Doe'.

'B.T. and J.T. maintained a hateful and abusive relationship toward each other, which included, but was not limited to, engaging in frequent fighting and arguing between themselves; abusing alcohol and getting drunk; and engaging in frequent fighting, physical abuse, and arguing with Jane Doe, which caused Jane Doe to suffer from emotional distress, anxiety, and major depression before she learned of any allegations [about Fogle and Taylor],' his lawyers argued.

Calling the parents' conduct 'outrageous and reckless', he claims that they drove her to consider taking her own life.

Jane Doe had told in her own legal case how she had considered suicide, slept with multiple sexual partners and turned to drink and drugs.

She claimed it was the impact of learning that she had been videoed by Taylor and Fogle which caused the trauma.

Fogle, however, pins the blame entirely on her parents and says that they should be liable for damages to their own daughter.

'B.T. and J.T., by their actions, caused Jane Doe to suffer from emotional distress and depression which then resulted in Jane Doe engaging in destructive behaviors, including, but not limited to alcohol abuse, substance abuse, self-mutilation, and suicidal ideation with regard to which B.T. and J.T. are liable,' the court papers say.

Fogle rose to fame in the 2000, when he appeared in the fast-food chain's advertisement, after dropping more than 200lbs (91kg), in part by eating Subway sandwiches.

He became its frontman for much of the decade, and became a millionaire in the process.

A raid on his suburban Indianapolis home and the resulting criminal case destroyed his lucrative career with the sandwich restaurant chain and his marriage.

He pleaded guilty to one count each of traveling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Taylor was not just Fogle's business partner, he was director of his charitable foundation.

He was jailed for 27 years for producing child pornography in his  house - among other charges. Fogle had solicited the footage from him.

He produced hundreds of films featuring young children. He is being sued, along with his wife Anglea, who has not been charged with any crime.

Many of the kids featured in the films - some of which depicted explicit sexual conduct - were known to Fogle, a former diet guru.

Fourteen victims have been identified, including Jane Doe.

He watched the pornography 'to fuel his sexual fantasies involving children,' prosecutors said.

Detectives also found commercial child pornography from Eastern Europe which included actual or simulated sexual intercourse by children as young as six.
