Former football player 'raped a woman dressed as a zombie schoolgirl at a Halloween party while drunk and high on cocaine'

A former South Adelaide footballer allegedly raped a woman as she lay sleeping dressed as a zombie schoolgirl after attending a Halloween party, a court has heard.

Nicholas Lionel Murphy, 27, who played in the South Australian National Football League, asked the woman 'have I made you feel uncomfortable?', after he sexually assaulted her, Adelaide District Court heard.

The court was also told that Murphy carried out the assault after he had drank alcohol and used cocaine, the Adelaide Advertiser reports.

Prosecutor Julie-Anne Lake said the woman's DNA had been found under Murphy's fingernails, and that the victim never once consented to his sexual acts.

'Just because a person doesn't physically resist doesn't mean they are consenting,' she said. 'She was asleep at the time Murphy had sex with her — she was incapable of consenting, she could not have consented, she did not consent.

'Murphy knew that she did not consent and, at the very least, was recklessly indifferent to her consent.'

Murphy, 27, pleaded not guilty to having digitally raped the woman, 20, on November 1, 2014 at a North Adelaide residence. The court heard that Murphy's friend, Christopher Ash, brought the alleged victim to the house. She had previously been to a Halloween party at a friend's house, 'dressed as a zombie schoolgirl'.

After accompanying Mr Ash to the North Adelaide address, Ms Lake said she 'twice had consensual sex with Mr Ash'. But after the second time, Murphy entered the room and lay down next to her on the bed.

'[Ash] was called away and [the woman] fell asleep ... the next thing she recalls is waking up [being raped],' Ms Law said.

'She moved away toward Mr Ash, who was sleeping next to her and Murphy left the room ... he returned, got in the bed and attempted to hug her. When she pushed him off, he asked "have I made you feel uncomfortable?"'  

The trial  is expected to run for four days.
