Judge OVERTURNS conviction of former private schoolgirl who was jailed for eight years for tricking a female friend into sex by pretending to be a man

A woman jailed for allegedly duping her friend into believing she was a man and having sex with her using a prosthetic penis has had her conviction quashed.

Ex-private schoolgirl 26-year-old Gayle Newland is being released on bail pending a retrial after three Court of Appeal judges reviewed the conviction.

She was jailed for eight years after being convicted of three counts of sexual assault at Chester Crown Court and sentenced by Judge Roger Dutton in November.

Watching the proceedings by videolink she broke down in tears, held her head in her hands and then wiped away the tears as she was told she would be released.

Lady Justice Hallett, sitting with Mr Justice King and Mr Justice Dove, said they made the decision 'with a heavy heart', as it means the victim will have to go through the ordeal of another trial.

She imposed reporting restrictions on the rest of the judgment pending the retrial, and made it clear that the alleged victim must not be named or identified in any way.

LESSER SENTENCES GIVEN TO PAEDOPHILES BY JUDGE WHO JAILED NEWLAND

Judge Roger Dutton gave Gayle Newland an eight-year sentence in November, which is longer than the terms he gave to people who sexually abused children in the past.

He once handed a teacher who abused 24 boys aged between eight and 13 to just six and a half years in prison.

In 2010, the judge jailed Michael Farrell for four years and eight months after he had sex with four 13-year-old girls - one became pregnant, suffered a miscarriage and then attempted suicide.

And in 2014, he locked up a former French teacher who was accused of abusing 24 boys in the 1970s to only six years and nine months in prison.

Keith Cavendish-Coulson, 71, preyed on boys aged between eight and 13 at a boarding school.

Jurors at Chester Crown Court previously heard how Newland took on an alter-ego, 'Kye Fortune', and disguised her gender.

Newland, a marketing manager from Willaston, Neston, claimed that her accuser always knew she was a woman, and that her disguise was part of a sex game.

After creating a Facebook profile, Newland was said to have taken on the persona of Kye.

Newland created the character of Fortune when she was 13 because she found it difficult to speak to girls in real life.

By the age of 15 or 16, she went on to develop a Facebook profile of 'half-Filipino, half-Latino' Fortune by downloading photographs from an American man's Myspace page.

Kye and Newland, a former University of Chester student, shared the same birth date and both liked RnB music and 'chick flicks' on their social media profiles.

A woman who posed as a man named Jason online to dupe teenage girls into having sex with her using a rubber penis had her appeal refused today.

Jennifer Staines, 23, was so convincing that one of her three young victims still doesn't fully accept that her 'boyfriend' was in fact a woman.

Staines, from Preston, Lancashire, was jailed for three years and three months after she admitted a string of sex offences against the girls, aged between 12 and 17.

She appealed the conviction, claiming that her motives were not sexual and that she just wanted to be loved.

However Mr Justice King today refused the appeal, saying he must have regard to the harm caused to victims and upholding the original sentence at Chester Crown Court.

He said: 'Our conclusions are these, given the number of victims, the extent of harm caused to them, the extent of appellant’s overall offending which lasted years, we can see no basis for any argument that this sentence was manifestly excessive.'
