Tom Sizemore sued by stuntman he 'ran over with SUV'... who claims actor was 'drunk and did it on purpose'

Tom Sizemore's on set Shooter accident was no accident, according to a new lawsuit.

The actor allegedly ran over a stuntman in an SUV while filming the series in July.

The injured stuntman is now suing the 54-year-old claiming he was drunk at the wheel, and that he drove over him intentionally.

TMZ reported on Friday Steve DeCastro suffered multiple broken bones after being pinned beneath the vehicle, almost fatally.

He filed a suit claiming Sizemore was both 'reckless and intoxicated'. 

He accused the Saving Private Ryan star of committing 'a willful and unprovoked physical act of aggression ... by intentionally ... running over his prone body.'

He also claims the producers glossed over it, instead of immediately firing him.

Sizemore told the site he was not under the influence, and even offered to take a urine test after the accident, but the producers said it was not necessary.

The incident occurred while filming a scene for the Ryan Phillippe show at Agua Dulce Airpark, near Los Angeles.

The scene was to end with Sizemore and actor Omar Epps sitting in an SUV, but Sizemore put the car in reverse and pulled out, unaware that the stuntman was behind him, TMZ reported at the time.  

The crew were filming a 'sniper scene' that was supposed to end with Sizemore and Epps entering the Cadillac Escalade and sitting there until filming ended.

That plan went to pieces, however, when the actor put the car in reverse and unexpectedly hit the gas, TMZ reported.

However, Sizemore's spokesman later announced that the actor had been given a signal to 'pull out' by a stunt coordinator on entering the car.

Three vehicles - including Sizemore's - moved on the signal the spokesman said, and the actor drove off, following instructions, unaware of the stuntman's presence until he heard the collision.

The stuntman was pinned beneath the vehicle, eyewitnesses said, and even the combined efforts of eight people couldn't lift it off him.

Eventually a jack was brought in to lift the car off him and he was airlifted to hospital.

He was described as being 'in real bad shape' by one first responder, TMZ said.

Sheriff's officials said any probe would be handled by the California Division of Occupational Safety and Health, which investigates work-related injuries.

Shooter is an adaptation of the 2007 film of the same name, which starred Mark Wahlberg as an army sniper who is framed for murder by a rogue private military company unit.

The show stars Philippe, Epps and Cynthia Addai-Robinson. IMDB lists Sizemore as playing 'CIA Agent Hugh Meachum', but only in the first episode, which airs on the USA channel in November.

The new series had its premiere delayed twice in the wake of the Dallas and Baton Rouge shootings this year.

It was also reported in August Tom had been dropped from the show after being charged with domestic violence against his girlfriend.

Sizemore has past issues with drugs, and was convicted of assault and battery in 2003 on his ex-girlfriend, Hollywood Madam Heidi Fleiss.
