California, like many other states in the US, prohibits the use of both handheld and wireless mobile phone devices while driving.

If the car is moving the offence carries a hefty charge in the Golden State, running as high as $200 for offenders.

Kate is often seen cruising around her stomping ground of Brentwood in LA, but has not been seen before with her phone in her vehicle.

The Bride Wars actress was alone in her car at the time, with neither of her two children in tow.

Kate is mother to Ryder, 12, who she welcomed with first husband Chris Robinson in 2004, and four-year-old Bingham, born from long-term relationship with Muse frontman Matt Bellamy in 2011.

Despite her and the rocker ending their engagement in 2014, the pair appear to still be on good terms - as they were spotted taking their son trick or treating last weekend, alongside Bellamy's new girlfriend Elle Evans.

The actress has moved away from the silver screen in recent years - focusing on her growing fitness empire instead.

She launched her own line of workout clothes and accessories, Fabletics, as a partnership with online retailer JustFab back in 2013 - which was met with great success.

Most recently, she released her book Pretty Happy: Healthy Ways to Love Your Body in February - which pens down her tips for keeping fit and well in both mental and physical senses.
