Bethenny Frankel says she's the victim of fraud and malpractice in suit over botched trust with ex Jason Hoppy 

Bethenny Frankel might not be into the holiday spirit just yet.

The Real Housewives of New York City personality has filed a lawsuit against an attorney in a dispute over a trust she had for an apartment she shared with ex-husband Jason Hoppy.

The 45-year-old reality star, TMZ reports, said in court docs that the lawyer, Jamie Andrew Schreck, fumbled in allowing Hoppy's mother Carol to act as a notary public over the trust in 2011. However, Hoppy's mother was ineligible to act as a notary in New York, the one-time talk show host said.

Frankel - who shares a six-year-old daughter named Bryn with Hoppy - said in court docs that as acting attorney, Schreck's unawareness of the mistake demonstrated legal malpractice, breach of contract, fraud, notary misconduct and breach of fiduciary duties.

The trust might be legally invalid in light of Carol Hoppy's ineligibility in serving as notary public, according to the Skinnygirl proprietor.

It's the latest bitter chapter in the post-script between Frankel and Hoppy, as the outlet previously reported that Bethenny's current beau, New York banker Dennis Shields was debating seeking court intervention in the ongoing tension between Bethenny and Hoppy, who were together from 2010 until their 2012 separation.

Via his legal team, Shields said that Hoppy has fired off 49 emails at Frankel - copying him on each one - over the last 70 days. 

Hoppy's emails came with 'increasing frequency and hostility,' Shields' attorneys said, adding that Hoppy told the moneyman he was one in a 'revolving door of men' his ex-wife had dated in the four years since they split.

Frankel and Hoppy finalized their divorce earlier this year, while Shields remains in the process of getting divorced from estranged wife Jill Schwartzberg.
