EXCLUSIVE: Amber Heard slams Johnny Depp in court after he REFUSES to make good on their $6.8 million divorce settlement because she wrote an open letter about domestic violence

The divorce settlement between Johnny Depp and Amber Heard has fallen apart, leaving the deal hanging by a thread, DailyMail.com can exclusively reveal.

The $6.8million settlement was close to being finalized in the last few days but Depp refused to pay the money at the 11th hour.

Now, according to bombshell legal documents seen by DailyMail.com, it appears the actor is stalling because he's furious over public comments his former wife has made about domestic violence in recent weeks.

Depp, who paid an initial $100,000 to two charities, is holding back on paying Heard the millions of dollars she has publicly vowed to donate to good causes.

Heard has promised to give the American Civil Liberties Union money for their work to stop violence against women, and the Children's Hospital Los Angeles will also receive a share.

But Depp's stonewalling leaves both organizations wanting - effectively penalizing the people they help.

The legal paperwork, obtained exclusively by DailyMail.com, reveals that because of the halt Heard's legal team is hitting back with a formal 'Request for Order' to the judge in the case in the hope that it will force Depp's hand once and for all.

In the documents filed with Los Angeles Superior Court, Heard's lawyers have asked the judge to act against Depp, 53, and enforce the terms of the settlement - known in the legal world as 'Deal Point Memorandum'.

Depp, who paid an initial $100,000 to two charities, is holding back on paying Heard (pictured on Tuesday) the millions of dollars she has publicly vowed to donate to good causes.

The filing, obtained exclusively by DailyMail.com, states that the 'Request for Order' arises because: '...despite months of efforts and repeated breaches by Respondent (Depp), the parties have been unable to reach agreement on a stipulated from of judgment.'

The document also lays out what Depp has failed to do in the time allowed by the court, which includes:

  • Not paying the first two installments of the 'equalization and legal fees payments' - known to amount to at least $6.8million.
  • Not giving Heard a date and time for a walk through of the couple's 'main Sweetzer property' (a $10million, eight bedroom castle style home in West Hollwood) and 'storage facilities' to retrieve her personal property.
  • Not transferring the title of a Range Rover.
  • Failing to meet with Heard to discuss the division of 'furniture and furnishings' in two residential units they once occupied together, Including their downtown apartment.

DailyMail.com understands Depp is furious that Heard has seemingly broken the terms of the settlement by speaking publicly about domestic violence - what he sees as a flagrant breach of the confidentiality clause agreed as part of the deal.

The legal document, signed by Heard's lawyers Pierce O'Donnell and Bernard M Resser, confirms this as an issue.

Heard caused a stir when she penned a letter for the December issue of the fashion magazine Porter writing about the subject of domestic violence and female empowerment, alluding to personal experience in the essay.

While she never mentions Depp by name, it's clear who she is referring to.

'You are not alone,' she writes. 'You may have suffered alone behind closed doors, but you are not alone. You need to know that.

'I want to remind you of your strength, a strength that has been multiplied by the number of women who stand silently behind you - a truth that allowed me to break down the doors I once found myself behind.'

She added: 'I never felt anyone would or could rescue me, so naturally I resented the label of victim.'

Heard also last month sat down for a Public Service Announcement (PSA) on domestic abuse.

She spoke up about domestic violence for GirlGaze Project.

The group shared a video to YouTube which saw the 30-year-old growing increasingly emotional and fighting back tears.

At the beginning of the clip, Heard recalled asking herself: 'How is this happening to me? I’m strong, smart, I’m not a victim.' 

'I guess there was a lot of shame attached to that, the label of victim,' she explained. 'It happens to so many women you know. When it happens in your home behind closed doors with someone you love, it’s not straightforward. If a stranger did this it would be a no-brainer.'

The actress added: 'Just as a woman having gone through this in the public stage, in the public arena that I did it, I have a unique opportunity to remind other women this doesn’t have to be the way it is, you don’t have to do it alone, you’re not alone. We can change this.'

Heard urged women who are experiencing domestic violence to speak up, no matter how scared they might be.

The problem with her statements is that her divorce settlement does include a confidentiality clause prohibiting her from talking about Depp - whom she doesn't mention by name in the video or the letter - but the viewer/reader is left with no doubt who she's talking about.

In a declaration attached to the filing Heard slams Depp for leaking stories about the divorce settlement claiming she's a 'gold-digger' and 'bragging' that she had settled for less than a previously reported sum.

Heard also states that Depp failed to pay the first installment of the 'equalization payments' on or before August 31, as required.

'Instead, when Johnny learned that I planned to donate my entire marital settlement to charities, Johnny purported to satisfy his obligation to pay me by supposedly paying the charities I selected instead of me,' she stated.

'He also claimed I violated the confidentiality provisions of the DPM by announcing that I was donating me settlement to charities.

'In fact I made this donations in good faith and I was responding to the leaks by Johnny's agents bragging that I had settled for sub scantily less than a reported, earlier offered sum and attempting to label me a gold digger.'

Heard states that another 'equalization payment' was due on November 1, but 'Johnny has not paid it either.'

'I understand Johnny's excuse for this default is that the form of Judgment has not yet been finalized and alleged breaches by me,' she stated.

After listing the things Depp has failed to do as part of the settlement agreement, Heard accused Depp and his agents of defaming her by leaking 'false' articles to the press.

She added: 'I am informed and believe that Johnny and his agents made false and defamatory statements about me both in violation of my legal rights and/or in breach of the DPM.'

The filing includes several examples of news articles Heard claims are false.

Heard filed for divorce from Depp in May after one year of marriage and obtained a temporary restraining order against him five days later after appearing in court with a black eye.

The couple reached a divorce settlement in August, with the actress in line to receive $6.8million, which she said she was donating to charity.

She also agreed to dismiss the restraining order against the Pirates Of The Caribbean star.

Four months on Heard has still not received the money promised in the agreed settlement.

When it does arrive the actress plans to split the money evenly between the American Civil Liberties Union for their work to stop violence against women, and the Children's Hospital Los Angeles.

In a joint statement to announce their divorce settlement, the former couple said: 'Our relationship was intensely passionate and at times volatile, but always bound by love.

'Neither party has made false accusations for financial gain. There was never any intent of physical or emotional harm.' 

It's been a bad year for Depp. Just as Alice Through the Looking Glass hit theaters in May, his divorce drama began.

The $190 million sequel to Alice in Wonderland crashed at the box office.

And thanks to recent ticket booth disappointments, Depp is this year's most overpaid actor according to Forbes.

His last three movies returned just $2.80 at the box office for every $1 he was paid on them.

While the furore around the domestic violence allegations towards him did not impact his earnings, Forbes claims they look set to damage his box office prospects for months to come.

Depp has suffered some high-profile misses including last year's Mortdecai and 2014's Transcendence.
