Morena Baccarin cleared by judge to take son to see dying great grandmother in Brazil as she beats ex Austin Chick in court

Morena Baccarin's three-year-old son Julius may get to see his ailing great grandmother after all.

According to TMZ, the 37-year-old Deadpool actress has been cleared by a judge to take her son back to her home country of Brazil after a legal spat with ex Austin Chick, who apparently waited too long to try to block the excursion.

The issue arose when Morena informed her ex-husband back in October that she intended to take her son to visit her dying grandmother.

But father Austin denied the request after raising concerns that Julius could be exposed to the Zika virus, telling the court he was worried about the fact the Centers for Disease Control and Prevention have said the long-term risks for children who contract the virus are unknown.

However Morena hit back, pointing out that their Julius' own pediatrician has said Zika is 'not a concern.'

The mosquito-borne illness has a range of symptoms including a mild fever, skin rashes, muscle and joint pain, and conjunctivitis. These normally last for up to seven days.

In addition, Austin also asked that Morena get their custody agreement authorized in Brazil in case something should happen to Morena on the trip.

However, when Morena's team tried to resolve that issue, Austin's people reportedly went silent in an apparent act of obstruction.

Morena also told the judge that she would hire top-quality security in the South American country and try to remain in the hotel as much as possible.

Austin does still have something positive to look forward to, as he was awarded custody of the children on Christmas Eve and Christmas Day prior to the trip.

Of course, Austin filed for divorce in July last year, citing irreconcilable differences. 

Just two months later in a legal declaration Morena said she was planning to marry OC hunk and Gotham co-star Ben McKenzie and that she was was pregnant with their child.

Their daughter Frances was born in March this year.
