Psychiatrist accused of raping female patient 'wore a disguise to sneak into jury room and post fake instructions' to try and influence his own trial

A Long Island man who prosecutors say wore a disguise and posted fake jury instructions during his own rape case has been indicted.

Former psychiatrist Marshall Hubsher, of Sands Point, was arraigned on Thursday, the Nassau County District Attorney's Office said in a news release.

Nassau County District Attorney Madeline Singas said in a statement: 'This defendant allegedly put on a disguise and attempted to tamper with a jury while it was deliberating his fate in another case.

'The integrity of the jury process is at the heart of our justice system and we will not tolerate anyone trying to tamper with or threaten jurors in Nassau County.'

Prosecutors said: 'DA Singas said that on March 21, 2016, while the defendant was on trial, he allegedly entered private jury rooms and placed signs there with falsified jury instructions in an attempt to tamper with a sitting jury deliberating on his trial.

'The note allegedly directed at the jury purported to be 'jury instructions' concerning reasonable doubt.

'A review of surveillance footage for the morning showed that the defendant allegedly first came into the courthouse wearing a leather jacket and baseball hat and holding newspapers.

Hubsher allegedly donned the disguise when he went to Nassau County Supreme Court in Mineola, New York, according to the New York Post

'He then allegedly left the courthouse – with the newspapers – and returned a short time later dressed in a suit and using a walker.

Newsday reported that Hubsher, 67, had been accused of sexually abusing a female patient he'd been treating for depression.

He was convicted of third-degree rape and a third-degree criminal sexual act charge, and is now serving two to three years, according to Newsday's report.

Hubsher was arraigned Thursday for burglary in the third degree and 13 counts of attempted tampering with a juror in the first degree, prosecutors said.

He has pleaded not guilty. Prosecutors said that Hubsher's bail was set at $49,000 and he's scheduled to be in court again January 18.
