EXCLUSIVE: Paula Patton demanded custody of their six-year-old son after he showed her how 'hard' Robin Thicke 'spanked' him but said to keep it a 'secret,' and then told a teacher dad 'punches' him

Court documents filed in the Superior Court of California, County of Los Angeles on Thursday detail the alleged series of events that led to Paula Patton seeking an emergency order granting her custody of son Julian.

The actress, 41, stated in her filing that she is concerned about the safety of the six-year-old boy in the wake of two incidents earlier this month where he allegedly spoke of being hit by his father, the singer Robin Thicke.

Patton claims that Julian complained to her on January 2 about how hard he was being hit by Thicke.

Two days later, the school called authorities to report that the boy had revealed to an employee he was being punched by his father.

Thicke, 39, was quick to respond to the allegations being made against him in his own declaration, claiming that he is an active and involved parents who coaches Julian's sports teams.

He also accused his ex of retaliating against him because she was banned from attending his father Alan Thicke's funeral.

A judge on Thursday appeared to side with Thicke, denying Patton's emergency order.

Department of Child and Family Services has also not issued any orders limiting 'custody or contact with [Thicke] in any way.'

Patton's filing provides a timeline for when Julian allegedly made his claims, beginning just after New Year's. 

'On January 2, 2017, the day before Julian was to return to school from Christmas Break, Julian told my mother and me that when Respondent spanked him it was really hard,' wrote Patton in her declaration.

'We asked him to show us how hard, and I asked him to hit me on my back. Julian hit me very hard and I said, ow. Julian said it was worse than that.

'I then told Julian I could not keep this secret anymore and that I have to protect him.' 

Patton said that her 'concerns culminated' two days later when 'Julian's school called Department of Child and Family Services to report what they believed to be credible allegations of abuse from Julian against [Thicke].'

An employee at Julian's school also submitted a declaration that was included in Patton's filing and revealed why DCFS was notified, stating that the boy said Thicke 'punches' him.

Patton also wrote in her declaration that in addition to the 'forms of punishment [Thicke] is using to discipline Julian,' she is also concerned with her ex-husband's 'drinking and drug use.'

Later in her declaration, Patton alleges that Thicke was drunk at Julian's Kindergarten graduation this past June.

'While in the Catholic Church where the ceremony was held, [Thicke] was hooting and hollering and making inappropriate jokes that the entire room could hear,' wrote Patton.

'He was calling attention to himself and behaving in an inappropriate manner.'

Patton also took aim at Thicke's behavior while coaching his son's soccer team, claiming he could be 'very unstable and erratic at times.'

She went on to claim that at some games Thick is 'very excited, running around with the kids and trying to coach them.'

In other games however, Patton wrote that Thicke 'seems very somber and does not participate in the games at all.'

Thicke however tells a much different story in his declaration, saying that on January 5 he was shocked when he learned just minutes before he was to pick up his son that Patton had gone it to get the child.

That exchange was included in Thicke's filing, and shows that Patton texted him to say that she had picked up Julian and would call him in five minutes, to which Thicke replied: 'OK. Can u bring him here for basketball lesson.'

Patton simply replied: 'No.'

The actress then called, with Thicke recounting the conversation the two had to the best of his ability, stating he was told by his ex: 'On Tuesday, Julian said that you spanked him. And today he said it again at school and they have called child services.'

Thicke claims that Patton also told him at this time: 'Julian is scared of you.' 

The singer was not allowed to see or speak to his son for four days after that conversation he stated, and when he did finally call Patton's home to speak to Julian he claims to have heard the boy say: 'Don't worry, I promise I won't tell him anything.'

The two had a good conversation claims Thicke, and then Julian called his father back again shortly after hanging up the phone.

Thicke claims that his son then said: 'Daddy, I just wanted to tell you on thing. Can you say you're sorry.'

When Thicke asked the boy what he would like him to apologize for, he claims Julian replied: 'For what mom told you.' 

Thicke does not deny meanwhile that he had spanked his son before, but claims it was never in an excessive or illegal manner.

'On a very rare occasion and only as a last resort, I will use light spanking, but it is consistent with the law - open hand on the butt,' said Thicke. 

'This is the type of discipline to which Paula and I agreed during our marriage.'

Robin was interview on Thursday afternoon by DCFS with Julian, and said he is happy to mediate any custody issue rather than have the matter decided in court.

Patton was just 16 when she met Thicke, then 14, at an underage club in Los Angeles.

They began to date seriously two years later, and were married in 2005, just as both of their careers took off.

Patton then gave birth to son Julian in 2010, but in 2014 the couple announced they were splitting after 21 years.

Their divorce was finalized in 2015, and Thicke is now dating 21-year-old  model April Love Geary.
