Pell is a grandson of Rhode Island's late Democratic U.S. Sen. Claiborne Pell, and he unsuccessfully ran for governor in 2014.

The two married in Providence in 2013.

Court records show Pell wants the Rhode Island filing to be dismissed so the divorce can be heard in California.

Kwan objects, saying she lived in Rhode Island for the past year.

Neither Kwan nor Pell returned phone calls seeking comment.

The couple has no children.

Kwan lists the date of separation as November. She spent part of last year working for Hillary Clinton's campaign and they also rented a home in Brooklyn for that period.

But she says her main residence was Providence, where she visited Pell on weekends. She lists Newport and California homes as 'vacation' properties.

Since November the Olympian staying at a motel in Newport while renovating the nearby home.

Court records seen by the Providence Journal indicate that Kwan tried and failed to serve Pell with divorce papers ten times in April.

Ultimately the court documents were tacked to the front door.
