Jim Carrey wins bid to use his ex-girlfriend's medical records in court as he fights wrongful death lawsuit after her fatal overdose on prescription drugs

Jim Carrey's legal team has won its bid to be able to use his ex-girlfriend's medical records to defend the actor in a wrongful death suit filed against him.

A lawyer for the actor, who has been embroiled in a wrongful death lawsuit after the overdose death of Cathriona White, 30, in September 2015, claimed that the woman was prescribed medication that could have been responsible for her death.

White's estranged husband Mark Burton and mother Brigid Sweetman, have alleged that Carrey gave her multiple STDs and provided her with the drugs with which she took her own life.  

Carrey's lawyer, Raymond Boucher, argued at Los Angeles Superior Court on Tuesday that White had recently had a breast augmentation and was prescribed medication that could have been responsible for her death. 

White's STD history will also be disclosed for the 20-day jury trial next April, the court ruled on Tuesday.

Carrey, 55, has maintained that his ex-girlfriend had a history of depression and denied all allegations he gave White any prescription pills and alleges she took them without his knowledge. 

White's family had tried to prevent the makeup artist's medical records from being used in court based on privacy grounds, but the court ruled that they should be disclosed.

Judge Deirdre Hill said: 'One of the issues is her prescription medication. We know she had breast surgery that month, we know she had oxycodone prescribed to her that month.'

The judge also ruled that White's STD history will be released to Carrey's legal team after White's family accused the actor gave her herpes 1 and 2 in 2013.

DailyMail.com revealed back in October that the STD test submitted as evidence in the wrongful death suit filed against Jim Carrey by Sweetman shows positive results for multiple diseases.

The Quest Diagnostics test belonging to 'Jose Lopez' and filed under seal has been seen by DailyMail.com and shows that 'Lopez' tested positive for Herpes I and II, Chlamydia and Hepatitis after being tested on January 28, 2013, with the results being reported three days later according to the test.

The date of birth for Lopez is listed as January 17, 1962, which is also Carrey's date of birth.

Sweetman and her attorney claim in court papers that 'Jose Lopez' is Jim Carrey.

Boucher said that Tuesday's ruling was an 'extremely important' victory for Carry.

He told The Telegraph: 'The most important thing is we want the medication evidence.

'We want to be able to establish that Mr Carrey absolutely did not transmit any herpes and he did not give her his pain medication and she could access her own.'

White's family's lawyer, Michael Avenatti, however, warned that Carrey's records could also be made public.

'We are pleased because now the same standard will apply to Mr Carrey. He should be very nervous,' he said.

Carrey began dating White, an Irish native, in 2012, but the two later broke up after it was revealed she had secretly married Burton to obtain a Green Card after her visa expired, according to court papers.

White allegedly attempted to taker her own life after the break up in January 2013, using medication she had obtained from her dentist, whom she was seeing for dental work.

Around this time, she also accused Carrey of transmitting multiple STDs to her, which he denied.

Following the confrontation, the pair broke up, with Carrey sending her a text message saying 'You have become too much drama.'

In a note to Carrey, White described herself as 'damaged goods' and claimed he called her a 'w***e' and an 'opportunist', threatening her with the help of 'fixers' to silence her.

Under California law, willfully exposing someone to a STD can constitute a cause of legal action for intentional infliction of emotional distress, a factor which can be relevant in determining a cause of suicide.

The pair got back together in 2014 and remained in a relationship for ten months until her suicide.

White was found dead in her Los Angeles home in 2015, surrounded by empty bottles of painkillers - drugs which were acquired by Carrey, lawsuits allege.

Her mother filed a suit last October demanding general damages, economic damages, funeral and burial expenses, punitive damages and attorney fees.

Last month, it was revealed that Carrey requested records from the three police officers who arrived to the scene, her medical prescriptions, including those from her dentist, and records from her physician who performed nasal surgery in 2014.

Court documents obtained by DailyMail.com showed the comic's lawyer served ten deposition subpoenas in April for business records on seven of White's medical providers for her medical, dental, and pharmacy records, and three police officers and investigators for records relating to the investigation of her death.

They were also served on Sweetman and Burton's lawyers, who objected to the demands.

However, documents show they would withdraw their motion if Carrey agreed to re-serve the papers without two requests for physical items collected at the scene of White's death - including prescription or non-prescription bottles, clothing, notes, computers, laptops, and cellular phones.

They also requested to view the evidence before it is turned over to him.

Carrey and his attorney stated that the other party's requests are 'completely unworkable,' as the items sought are relevant to the case.

Earlier this week it was revealed in a documentary titled Jim Carrey: I Needed Color, that the star began painting after a challenging breakup to heal himself after his split from Jenny McCarthy in 2010.
