Jennifer Hudson's estranged husband gets PRIMARY CUSTODY of their son because 'she has to travel for work' as she DROPS 'order of protection'

A sea change has taken place in the custody arrangement between Jennifer Hudson and her estranged husband David Otunga over their son David Jr.

On Tuesday TMZ reported David has been granted temporary primary custody of the boy, aged eight, because the beauty travels so much for work.

Hudson, who came to fame on American Idol, has been traveling to the UK for The Voice.

The Blast had earlier reported that the songbird had dropped her order of protection against David as long as he did not return to their family home.

On Wednesday, TMZ reported that the star's reasons for dropping the restraining order keeping her ex away from their son was only in the son's interest.

According to the website, when she said in legal documents that she was concerned about the 'physical and emotional safety' of herself and her son, she was referring to any possible emotional scarring the child might suffer from witnessing his father threaten his mother - not accusing Otunga of physically threatening their offspring.

David hd previously argued that he has been the primary care giver for their son ever since birth because Jennifer's work schedule is so heavy. 

Indeed, in the past eight years she has kept very busy. Since 2009 she has made eight movies including The Three Stooges, Lullaby, Sing and Sandy Wexler.

She has also appeared on the TV show Empire as well as Hairspray Live! and Inside Amy Schumer.

Hudson has worked this year on both The Voice UK and The Voice US.

Otunga will be the primary caregiver until a more permanent deal is made, according to the site.

Jennifer has also 'voluntarily dropped her order of protection, which prohibited David from having contact with their son or her,' the site added.

This comes after she allowed him to take their child for Thanksgiving. 

According to People, the 36-year-old Oscar winner 'voluntarily agreed' to allow the 37-year-old Harvard Law grad to have David Jr from Thursday at 3PM to 7PM Friday.

Their next custody court date on December 7.

According to TMZ, David also requested to remain at their Chicago residence during the two weeks (November 26-December 8) Jennifer will be traveling for work.

Hudson had Otunga thrown out of their home and told Illinois' Cook County Court he displayed 'increasingly aggressive, threatening, and harassing behavior.'

The retired wrestler has vehemently denied all of the Remember Me songstress' allegations of abuse and intimidation with firearms. 

Before the legal drama, many doubted the couple would ever walk down the aisle due to their eye-popping, nine-year-long engagement.

Both kickstarted their careers on reality competitions - Hudson placed seventh on Fox's American Idol in (2004), and Otunga placed third on VH1's I Love New York 2 (2007).
