Significance and Necessity of Brand Protection

The name, emblem, mascot, etc. of the PyeongChang 2018 Olympic and Paralympic Winter Games (the “Games”) designated by the PyeongChang Organizing Committee for the 2018 Olympic & Paralympic Games (POCOG) are the “Games Brand,” to which POCOG holds the rights. The right to use the Games Brand in marketing, etc. is exclusively granted to official sponsors.

Brand protection refers to any and all activities to ensure proper use of the Games Brand including the emblem, mascot, slogan, etc. and to protect its value. Brand protection is very important to preserving the legacy, spirit, and value of the Games. Management of the Games Brand is very important for raising funds for the successful hosting of the Games.

The use of the Games Brand below requires prior approval from POCOG in accordance with Article 25 of the Special Act on Support for the 2018 PyeongChang Olympic and Paralympic Winter Games (the “Special Act”), Article 10 of the Enforcement Decree of the Special Act, and contracts signed with the International Olympic Committee (IOC), the International Paralympic Committee (IPC), the Korean Olympic Committee (KOC), and the Korean Paralympic Committee (KPC). The word marks below are registered as trademarks at home and abroad and require prior approval from POCOG for use.

Other Games Brand designated by POCOG

  • Medals, diplomas, slogan, theme song, Games flag, Olympic coin and stamps, official publications, poster and uniform designs, Look of the Games, and any mark, design, slogan, or music which includes any symbol above, and any item similar to any symbol above.

Laws regarding Brand Protection

The Games Brand can only be used by POCOG, official sponsors, broadcasting right holders, licensees, and other non-commercial entities that obtained approval for use. POCOG protects the Games Brand by applicable laws and regulations including the Special Act, Trademark Act, and Unfair Competition Prevention and Trade Secret Protection Act as follows.

Special Act on Support for the PyeongChang 2018 Olympic and Paralympic Winter Games

Anyone who uses POCOG-designated insignia, mascot, or other Games symbols, or any mark, design, slogan, or music which includes the symbols, or any item similar to the symbols without prior approval from POCOG may be imprisoned for up to five (5) years or fined up to KRW 50 million.

Uses of the Games Brand Permitted without Approval from POCOG

Use by a right holder who was registered in accordance with the Trademark Act and the Design Protection Act

Use after gaining approval from the IOC or the IPC

Use for editorial or educational purposes

Anyone who uses the “PyeongChang Organizing Committee for the 2018 Olympic and Paralympic Winter Games (POCOG)” or a title that is similar to POCOG may be fined up to KRW 5 million.

Trademark Act and Copyright Act

Anyone who infringes upon the trademark of the Games Brand may be imprisoned for up to seven (7) years or fined up to KRW 100 million.

Anyone who infringes upon the copyright of the Games Brand-related image, video, music, etc. may be imprisoned for up to five (5) years and/or fined up to KRW 50 million.

National Sports Promotion Act

Anyone who intends to use the Olympic rings, the symbol of the Olympics, or any mark, design, or slogan which includes the rings, or the like similar to the rings for commercial purposes shall obtain approval therefor from the Korean Olympic Committee (from POCOG until December 31, 2020), and those who have obtained approval for use shall pay relevant fees.

Unfair Competition Prevention and Trade Secret Protection Act

Anyone who uses the same or similar Games Brand widely known at home and causes any confusion with the goods or business activities of right holders or undermines the identification or reputation of right holders may be imprisoned for up to three (3) years or fined up to KRW 30 million.

Non-commercial Use of the Games Brand

Non-profit organizations may use the Games Brand to promote the Games for non-commercial purposes.

Examples of Non-commercial Use

Editorial or educational purposes:Use for purely editorial or educational purposes (i.e., the Games’ emblem is used in media reports on the progress of the Games, or the Games’ title is used in classroom material that introduces the Games, etc.) is allowed without approval from POCOG, provided, however, that any use intended to circumvent or avoid the limitations by laws concerning Brand Protection is prohibited.

Factual statement:The phrase “OO Olympic gold medalist” written on a business card as a profile introduction, or the sentence “Olympic gold medalist Kim OO will attend” on an event poster is allowed without approval from POCOG, provided, however, that any use intended to circumvent or avoid the limitations by laws concerning Brand Protection is prohibited.

Approval by POCOG:Any use of the Games Brand other than for editorial or educational purposes and factual statement mentioned above requires prior approval from POCOG. Commercial use, in particular, is only permitted after signing contracts with official sponsors selected by POCOG through a marketing program. Any other non-commercial use is allowed after following application and approval procedures for non-commercial use of the Games Brand and obtaining written approval from POCOG if it falls under the following approval conditions.

Conditions for Approval (example)

Applicants shall be non-profit organizations involved with the Games.

The Games Brand shall be used non-commercially for promoting the Games.

The Games Brand shall not be exposed along with any other commercial logos.

The Games Brand shall not be used to promote any third party directly or indirectly.

Applicants shall comply with the Guidelines for Use of the Games Brand.

Applicants shall observe the Olympic Charter and the Olympic spirit.

Applicants shall face civil and criminal liability if they violate any condition above.

Brand Management System

POGOC opened the brand management system to ensure that anyone may apply for approval for non-commercial use in a smooth and swift manner and report unauthorized use of the Games Brand with ease.
