Alex Rodriguez may want to sue the person who posted a photo of him while he sat on the toilet in his luxury Manhattan apartment, but the law may not be on his side. 

A photo of J.Lo's fiancé sitting on the can in their $17.5million apartment is being circulated on social media - and his lawyers are looking to sue whoever took it.

The snap, which is believed to have been taken by someone working at a hedge fund in the building next door, shows A-Rod playing on his phone while relieving himself.

Rodriguez decided against closing the curtains while visiting his marbled washroom at their New York City pad, and he can be clearly seen sitting on the throne in a blue shirt.

The white bathroom even has towels monogrammed with the letter A. 

A source told Page Six: 'Alex's lawyers are all over this. They are working hard to find out who the culprit is. It is a clear breach of privacy.

'The photo was obviously taken from the building next door, from a floor possibly parallel to Alex's apartment. 

'One of the hedge funds in the building next door will be getting a big lawsuit.' 

But legal experts told Page Six that the relatively lenient privacy laws in the State of New York may not work in A-Rod's favor.

'Under current case law, he has no case,' said Brad Shear, a sports and privacy lawyer for Digital Armour Group. 

'Under New York law, you better put your blinds down. He’s lucky he wasn’t standing there buck naked.' 

The Harbinger Group, Ortelius Capital Partners and JMP Securities all have offices near the apartment.

Jennifer Lopez and Rodriguez are currently looking to sell the three-bedroom four-and-a-half bathroom Gotham penthouse which has views of Central Park.

The 4,000 sq. foot penthouse is located at 432 Park Avenue, which is the tallest residential building in the world.

Inside, both Lopez and Rodriguez have their own bathrooms.

The power couple, who were first romantically linked in March of 2017, 'love the building, but when their kids are all together, it’s too small,' a source told Page Six of the reason behind the sale. 'They need something bigger for the family.'

The 49-year-old actress-singer is mom to twins Max and Emme, 10, with ex Marc Anthony, while the 43-year-old baseball alum is father to two daughters Ella, 14, and Natasha, 10, with ex Cynthia Scurtis.

The property offers sweeping views of Central Park and the New York City skyline.

While the palatial pad only has three bedrooms, the incredible views from every corner provide a rationale for the seriously hefty price tag.
