  • Smollett was filmed in his black Mercedes driving in Chicago on January 27
  • Police say he was on his way to meet brothers Abel and Ola Osundairo
  • The photographs were released among more than 4,000 pages of evidence
  • They came from State's Attorney Kim Foxx's office on Friday afternoon
  • Also in the files are the brothers' mug shots and a photo of the rope that was placed around Smollett's neck
  • Photos of the bottle of hot sauce containing bleach the brothers poured on him are also included
  • There are still videos and photographs that are being redacted by Chicago PD

Buried in the thousands of pages of evidence released by Cook County State's Attorney Kim Foxx's office on Friday night as part of the ongoing Jussie Smollett fiasco are surveillance photos of the Empire actor in his Mercedes, allegedly driving to do a 'run through' of the attack police say he staged.

The photos are of Smollett's black Mercedes and were taken on January 27 in  Chicago at around 12.30pm.

The attack was meant to happen the next day, on January 28th, but was set back because Smollett's flight was delayed from New York City

The brothers say he was angry that he did not receive more attention when he got a racist and homophobic letter from Empire.

He was on his way, according to police, to pick up brothers Abel and Ola Osundairo to do a 'run through' of the attack they allegedly staged together on January 29.

Smollett maintains it was a legitimate attack and that he was the victim.

The photos of his car were released on Friday among thousands of other documents obtained by DailyMail.com via an FOIA request and under the decision of a judge to unseal all the police and prosecutor documents attached to the case.

There are also photographs of the white rope the brothers placed around Smollett's neck and the bottle of hot sauce containing bleach which they then discarded.

The release of the documents comes after months of legal back and forth between the court, the prosecutor's office and the media.

When Foxx's office suddenly dropped the charges against Smollett in March, a judge agreed - at his attorney's request - to seal the file.

Since then, the empire actor's lawyers have given interviews about the case and he has also made public statements.

A judge earlier this month decided to reverse the seal because, as they put it, Smollett was no longer entitled to privacy.

Last week, the Chicago Police Department released 400 of the thousands of pages it has on file.

Police are still redacting videos and photographs which they will release next week.

The bulk of the files released by Foxx's office are emails between her staff, their correspondence with local reporters and text messages about the story.

Much of the actual investigation into the attack and then into Smollett was already in the public record.

Smollett was facing 16 felony counts of lying to police and a possible 48 year prison sentence until Foxx's office dropped the charges.

Prosecutors have since said that they believe he is guilty but that he qualified for 'deferred' prosecution.

She is now awaiting a judge's decision on whether or not she should be investigated for misconduct.

Before recusing herself from the case, she exchanged text messages with one of Smollett's relatives and a family representative.
