Husband of missing Connecticut mom goes for a jog with his ankle monitor on the morning after posting $500,000 bail - as his lawyer says he DOES have an alibi which proves he did not kill her - he was 'at home'

  • Fotis Dulos was seen jogging near his home in Farmington on Wednesday
  • The 51-year-old posted bond on Tuesday on charges of tampering with evidence
  • He is accused in the disappearance of his estranged wife Jennifer, 50
  • His socialite girlfriend, Michelle Troconis, is also charged in the case
  • Jennifer vanished on May 24 after dropping their five kids off at school
  • She and Fotis had been locked in a bitter custody battle for years
  • But his attorney says he was at home with a different lawyer the morning she vanished
  • He claims he would then not have had enough time to go to his ex's house, attack her and make it back to his house that afternoon
  • The pair live 70 miles apart in affluent areas of Connecticut

The estranged husband of missing Connecticut mother Jennifer Dulos was filmed jogging on Wednesday after posting $500,000 bond on charges of tampering with evidence in the ongoing case of his vanished wife.

Fotis Dulos, 51, and his girlfriend Michelle Troconis have been charged in the disappearance of Jennifer Dulos, 50.

She has not been since 8.30am on May 24 after she dropped off the couple's five children at school.

According to police, Fotis attacked her in her home sometime before 11am that day.

They have not found Jennifer's body but authorities have found trash bags that were dumped in cans that night, by someone who looks like her ex-husband, which have traces of her blood.

Fotis's attorney insists he is innocent and said on Wednesday that he has a clear alibi: he was at home with a different attorney during some of the window cops say Jennifer was attacked and would not have had enough time afterwards to get to her house, harm her and race back to his own.

Missing: Jennifer Dulos has not been seen since 8.30am on May 24 when she dropped her five kids off at school

Missing: Jennifer Dulos has not been seen since 8.30am on May 24 when she dropped her five kids off at school

The alibi can be verified by 'multiple' witnesses, his attorney said, including a different attorney his client happened to be meeting with at his house in Farmington until 9am - 30 minutes after Jennifer was last seen alive, 70 miles away.

The lawyer claims that he would not have had enough time to drive from his home to his ex-wife's, attack her in the garage and then race back to his property by 1.30pm - when prosecutors confirm he was home.

What's more, Pattis says Dulos' co-defendant girlfriend came home at 11am and saw him there.

He says that if cell phone data does not match his timeline, it is because someone else must have taken the father-of-five's devices out of his home.

TIMELINE

May 24

8.30am: Jennifer Dulos is seen for the last time dropping off her children at school

9am: Fotis Dulos' meeting with an attorney, who has not been named, comes to an end at his home in Farmington, his lawyer says

11am: Fotis' co-defendant and girlfriend, Michelle Troconis, comes home to their house in Farmington and confirms he is there. It is unclear where she had been.

12pm: Housekeeper goes to Jennifer Dulos' home in New Canaan and finds nothing of note

1pm: Jennifer Dulos misses her second appointment of that day

1.30pm: Police say Fotis Dulos was back in Farmington by this time, proven by phone records

7.10pm: Fotis phone shows him in Hartford, near where trash bags containing his wife's blood were found

'There is no dispute between Mr. Dulos and the state that he was back in Farmington by 1:33 [p.m.]

'So to our minds that is an effective alibi. Because in order for him to have accomplished this crime, Ms. Dulos dropped the kids off at school at about 8:30 [a.m.].

'The housekeeper was back in the house by about noon and didn't notice anything amiss. Apparently hadn't gone into the garage.

'He would have had to confront Ms. Dulos in the garage or some other part of the house, kill her, try to clean up, dispose of the body in broad daylight on a well populated section of the state and get back to Farmington,' he said.

'If the electronic data confirms that his devices were in use at that location, it’ll be an open question whether he was using [the devices] or someone else was.

'But from where I come from, this is the beginning of an effective alibi defense.

'The alibi is enormous,' Pattis told ABC on Tuesday.

He could not explain why a man, fitting his client's resemblance and driving the same car as him, was seen that night with a woman who looks like Troconis, disposing trash bags in cans along a road where, when tested later, police found traces of Jennifer's blood.

He described the bloody trash bags as an 'anomaly' but also tried to cast doubt on how many had actually been found.

Initially, police said 30 bags were dropped off. Pattis says he has been told there were only two but that in any case, they do not prove his client killed his wife.

'That is an anomaly that I cannot yet account for,' he said.

'This is a troubled couple going through troubled times.

'I simply don't know [where Jennifer Dulos is] and he doesn't know either. There are troubling questions or good reason for the police to search and conduct their inquiry [into her disappearance].

'I'm not disputing that. We are anxious to meet those accusations and clear his name,' he said.

Fotis Dulos left court on Tuesday afternoon after posting $500,000 bond following his not guilty plea to charges relating to the disappearance of his estranged wife.

Fotis, still dressed in his orange jumpsuit, walked out the front of Stamford Superior Court flanked by law enforcement and climbed into a black SUV before being driven off.

Earlier, Fotis had appeared, wearing handcuffs, in family court at the Stamford courthouse for a custody hearing for his five children.

He pleaded the Fifth Amendment against self-incrimination when his wife’s divorce attorneys asked that he take the stand to testify in the child custody case.

Michael Meehan, an attorney and guardian for the five Dulos children, who are aged eight to 13 years old, said he had visited them at their grandmother’s home last week and said their emotional and financial needs are being met.

Lawyers for Jennifer and her mother, Gloria Farber, asked that the grandmother be granted custody of the children who have been staying in her New York City apartment since their mother went missing.

Fotis’ divorce lawyer, Michael Rose, asked that the status quo be observed with Farber continuing to have temporary custody.

Judge Donna Heller ordered a recess on Tuesday while she came to a decision in the case.

Fotis Dulos hired a new criminal defense team this weekend led by Alex Jones' attorney Norm Pattis who has claimed that there is 'no evidence' to prove his client was involved in 'foul play'.

At the hearing on Tuesday, State's Attorney, Richard Colangelo Jr, told the court that investigators found Fotis Dulos' DNA mixed with his wife's blood on a faucet in the kitchen of her New Canaan home.

On Tuesday, both Fotis and his socialite girlfriend, Michelle Troconis, 44, pleaded not guilty to charges of tampering with evidence and hindering prosecution.

The judge asked that Fotis remain in Connecticut, surrender his passport and be fitted with a GPS monitoring device. He set the next court date for August 2.

During the hearing, Pattis said: 'There's enormous public interest in the case.

'Mr Dulos is being tried and convicted in the court of public opinion of a crime he has not yet been charged with.

'What we know is that Jennifer went missing.

'We have been able to account for Mr Dulos' movement for all of that time.'

Pattis said that the prosecution has been 'fueling speculation that there's a dismembered body'.

He called the prosecution's theory 'ludicrous'.

'There is no body we are aware and I'm sick of hearing about it...my client is entitled to the presumption of innocence. 'We don't know where Jennifer is,' Pattis said in court.

Pattis also noted that, at the time of Jennifer's disappearance, the custody case was moving in his client's favor, adding that the court had made 'adverse findings about Jennifer's mental health' which he did not want to put on the record at this time.

According to Pattis, Troconis' lawyer, Andrew Bowman, won't speak with him about what she told Colangelo.

Colangelo asked for Fotis Dulos's bond to be increased to $850,000 because the case is 'fluid'.

He told the court that the 'lab was able to confirm that the defendant's DNA was found in a mixture with the victim's blood on the faucet in Jennifer's kitchen'.

According to Dulos' attorney Norm Pattis, Troconis' lawyer, Andrew Bowman, won't speak with him about what she told Colangelo (she is pictured entering court on Tuesday)

Pattis admitted that his client was at Jennifer Dulos' home days earlier which would account for his DNA.

Colangelo replied that Dulos was at the home days before Jennifer Dulos disappeared - but did not enter the house and was only in the back yard.

Pattis asked to have the trial expedited to August.

‘Mr Dulos is tired of sitting back and hearing people pick apart his motives. We are ready for trial now,’ the attorney said.

'If he becomes eligible then, I assure you, the court will accommodate him,' the judge responded.

Outside court, Pattis said that he believed Troconis is cooperating with prosecutors.

'She spoke to the state, they won’t give us a copy of what she said.

'You don't talk to the state voluntarily unless you’re cooperating somehow. She wants something from them. The question is what did they offer her and what did she give them? As near as we can tell, she gave them nothing,' Pattis said.

Troconis appeared in court on Tuesday ahead of her boyfriend. She pleaded not guilty to the charges.

She was dressed in grey slacks with silver flats, a striped blue blouse and a grey cardigan.

Troconis was accompanied to court by her sister, mother and father.

Her next court date has been set for July 18. Troconis has been out on a $500,000 bond since last week after surrendering her passport and being fitted for a GPS ankle monitor.

Investigators have spent the last week systematically searching properties connected to The Fore Group, Fotis’ construction company, and the acres of woods behind the former family home in Farmington.

Police have also searched Jennifer's New Canaan home where she lived with her five children after filing for divorce in 2017.

The couple's five children, aged eight to 13, are being cared for by their grandmother Gloria Farber in her New York City apartment and are being protected by armed guards.

Fotis and Jennifer had been locked in a vicious custody battle for their five children for the last two years.

A divorce filing from the missing woman stated that she feared her estranged husband would harm her and that he owned a gun.

It also emerged that Fotis was fighting his wife’s mother in court after he failed to pay back $1.7million in loans to his company.
