Conservation of Salmon and
Sea trout Bye-Law No 781, 2001
I, Frank Fahy, Minister for the Marine and
Natural Resources, in exercise of the powers conferred on me by section 9 (as
amended by section 3 of the Fisheries (Amendment) Act, 1962 (No 31 of 1962), and
by section 33 of the Fisheries (Amendment) Act, 1962, and the Fisheries
(Transfer of Departmental Administration and Ministerial Functions) Order, 1977
(as adapted by the Marine (Alteration of Name of Department and Title of
Minister) Order, 1997 (S.I. No 301 of 1997), hereby make the following Bye-Law;
1. This Bye-Law may be cited as the
Conservation of Salmon and Sea Trout Bye-Law No 781, 2001
2. This Bye-law comes into operation on
January 1st, 2002
3. In this Bye-law -
"salmon means a fish of the species Salmon
salar (Atlantic salmon);
"sea trout means a migratory form of Salmo
trutta but does not include a sea trout which is 40 centimetres or less in
length measured in a straight line from the tip of the snout to the fork of the
tail.
4. Notwithstanding anything contained in
any Bye-law prohibiting the taking, or having possession of, more than one
salmon or sea trout it is prohibited for any person to take more than one salmon
or one sea trout (in this article referred to as "the taken fish") in any day by
rod and line during the period of January 1st to 31 May in any year unless any
salmon or sea trout other than the taken fish is returned, without avoidable
injury, to the water immediately upon being taken.
5. It is prohibited for any person to have
in his or her possession any fish taken in contravention of article 4 of this
Bye-law
6. This Bye-law shall not affect the
operation of any other Bye-law which prohibits the taking, or having possession
of, salmon or sea trout

EXPLANATORY NOTE
(This note is not part of the Bye-law and
does not purport to be a legal interpretation)
The effect of this Bye-law is to prohibit
the taking by rod and line of more than one salmon or sea trout (over 40
centimetres in length) by any person in any day from 1 January to 31 May
FOOTNOTE
Section 11 of the Fisheries
(Consolidation) Act, 1959 as amended by section 27 (b) of the Fisheries
(Amendment) Act, 1999 provides that any person aggrieved by this Bye-law may
within 28 days after its publication in the Iris Oifigiuil, appeal same to the
High Court.
