• Important New Home Warranty (NHW) of British Columbia update

   Under the Proposal in Bankruptcy in respect of NHW as amended on September 16, 1999, all creditors were required to file their Proofs of Claim by August 30, 2002. This deadline, the “Bar Date”, applied to all creditors including “IBNR Claimants”, that is, “persons who are entitled to the benefit of the warranties issued by the Program, who are presently unaware of any basis for making a claim, but who in the future would be entitled to make claims under the terms of the warranties based upon future problems which will be known but are not known now.”

  An order was granted on May 21, 2002 in the Supreme Court of British Columbia providing that “the ‘Bar Date’ as provided for in the Proposal solely insofar as it relates to the IBNR Claimants herein be and is hereby extended to December 31, 2002.” Note: IBNR Claimants (warranty holders) must now file their Proofs of Claim by the earlier of the expiration of their warranties or by December 31, 2002. All other Creditors must file their Proofs of Claim by August 30, 2002.
