you agree to be bound by the Terms and Conditions set forth below.
1.
Provider
StayPoland is a brand product of the Provider: Old Town Apartments
Sp. z o.o., a company incorporated in Poland with limited liability, whose registered
office is at ul. Piekarska 14/6, 00-270 Warszawa (Warsaw). StayPoland. is certified
as Travel Agency and holds insurance by Warta SA; The provider is referred below
to as StayPoland;
2. Hotel
Hotel is an accommodation institution
listed on www.staypoland.com, which the User reserves on the basis of the information
on STAYPOLAND web site and orders through the Service;
3. User
User
is an individual or legal entity that uses the Service;
4. Service
Service
is providing assistance in accommodation, car and travel reservations via the
web site www.StayPoland.com and other means. Reservations are subject to applicable
taxes and fees;
5. Rights and obligations of the Provider
The
Provider is authorized to block the User, who at any time in the past violated
the valid Terms and Conditions of the Contract from the provider.
The Provider
does not take over liability for any damage caused by cancellation or change of
reservation on the part of the Hotel. In such case the Provider will provide an
effective assistance defending the User's case, being ready to find other accommodation
of comparable price, standard, and location.
The Provider is responsible
for sorting the accommodation into categories according to location and preferred
hotels. The Provider is obliged to monitor client satisfaction and to check systematically
the hotel standard. The Provider guarantees all reservations made as a part of
special travel packages.
The Provider guarantees the security of the personal
information about the User;
6. Rights and obligations of the Hotel
The
Hotel is responsible for accuracy of information delegated to STAYPOLAND. The
Hotel supplies the Provider with information and is asked to confirm the Hotel
page's content;
7. Rights and obligations of the User
The User
must not use a false name when using the Service. When reserving the accommodation
the User must supply the Provider with their credit card details valid until the
User's departure date from the reserved Hotel. The User does not have to provide
their credit card in case the Hotel permits prepayment.
The User accepts that
prices, restrictions and availability of products and services may change without
notice;
8. Indemnification
You agree to indemnify, defend and
hold harmless staypoland.com, its officers, directors, employees, agents, licensors,
suppliers and any third party information providers to the Service from and against
all losses, expenses, damages and costs, including reasonable attorneys' fees,
resulting from any violation of these Terms and Conditions (including negligent
or wrongful conduct) by you or any other person accessing the Service;

Limitation of Liability and disclaimer
The Provider does not guarantee
the accuracy, availability, quality, timeliness, completeness, performance or
fitness for a particular purpose of any part of this site, any content (with the
exceptions stated in section 5) or any accommodation, products or services available
via this site or guarantee that this site is free from viruses, worms or Trojan
horses.
It is impossible to guarantee the accuracy and completeness of all
the data considering the scope of services StayPoland offers. Despite it, we undertake
utmost effort that our information is unparalleled in the amount of information
details and constantly reliable.
10. Privacy policy
The Provider
guarantees that credit card information submitted to the Server are handled with
utmost privacy and are shared solely with the accommodation facility which confirms
the reservation. We use Secure Socket Layer (SSL) encryption (Thawte) which effectively
restrains access to private information from a third party and ensures that your
information is securely and quickly authorised. We use all means to prosecute
unauthorized access to our systems.
11. Hotel categories and Hotel information
All
additional hotel information and descriptions are based on those supplied by the
Hotel. The internationally recognized classification by star-rating provides,
without obligation, an indication of the hotel standard. Several Polish hotels
have not yet been assigned the appropriate hotel category and this fact is always
mentioned in the specific hotel pages.
The Provider undertakes great efforts
to supply the User with the most up-to-date information about the standard and
services of the Hotels listed on www.StayPoland.com.
12. Category "preferred
hotels"
In dependence on 1/User satisfaction data which we receive
in feedback e-mails and 2/ the turnover of our sales we may list some of the accommodation
facilities as "a preferred hotel". This title reflects current performance
of the particular accommodation facility and is subject to update every four months.
The Provider reserves the rights for listing accommodation facilities in this
category.
13. Conditions of the Hotel accommodation
Conditions
of the Hotel accommodation vary. The precise formulations are available at the
respective hotel pages.
14. Reservation and confirmation
Every
hotel reservation made by StayPoland will be transmitted to the appropriate hotel
by the Provider as agent for your order. Formal confirmation is sent to the User
without any delay, at the latest within one working day.
The reservation is
held at the Hotel until 5 p.m. local time on the day of arrival. In case of late
arrival you have to indicate the late arrival in the reservation comments field.
Reservation
and change of reservation are free of charge. All reservation changes are valid
only if they are formally confirmed by the Provider. Cancellation policies vary
according to conditions of the Hotel. All cancellation policies are listed on
the StayPoland hotel pages and displayed on the confirmation letter.
15.
Room rates
Unless specified otherwise, all prices displayed at www.StayPoland.com
are contractually agreed room rates which are valid for only of the clients who
make a booking in www.StayPoland.com. These rates are either official hotel rack
rates or special discounted rates available solely through StayPoland.
Through
the express reservation page special supersaver rates may be available. All the
price variations depend on special rates availability and are always confirmed
by the Hotel. The Hotel is responsible for the validity of the rack rates price
information supplied to StayPoland. The Provider guarantees all reservations made
as a part of special travel packages.
Most Hotel rates are presented per room
and per night including breakfast and VAT. All cases when the Hotel does not include
breakfast into the room rate or if the prices are per person per night are marked
separately in the Hotel reservation form.
16. Prices and conditions
of payment
With the exception of 10 EUR fee for cancellations, the User
does not pay any charge for Using the Service. The User pays the negotiated price
to the Hotel usually when they check out. Unless specified separately, User's
credit card details are required to guarantee all hotel reservations.
17.
Force Majeure
The Provider cannot be held accountable for damages and changes
to reservations caused beyond the control of the company (including and without
limitation, acts of God, explosions, floods, tempests, fires, accidents, war or
threat of war, sabotage, insurrection, civil disturbance or requisition, sickness,
quarantine, government intervention, weather conditions or other outwards occurrences)
18. Final provision
If a provision of these Terms and Conditions
turns unvalid, it will not influence validity the Terms and Conditions as the
whole. The conflicting issues are subject to be resolved by jurisdiction of Law
Courts of Polish Republic
19. Changes to the Terms and Conditions of
Use
The Provider reserves the right to do changes to the Terms and Conditions
of Use. These conditions were given publicly and are valid from December 20, 2002
onwards. |
