WE ADVISE YOU TO KEEP THE RENTED CAR ONLY AT GUARDED AREAS!

Definitions:
For the purpose of this Agreement the following definitions mean:
1. "THE LESSOR" means Local Rent a Car - Poland Tourist Service Sp. z o. o. represented by its employee.
2. "THE RENTER" means the person, firm or organisation by or on behalf of whom/which this Agreement is signed.
3. "AUTHORISED DRIVER" means the drivers additional to the RENTER approved and entered in the Agreement by the LESSOR. The RENTER will ensure that any AUTHORISED DRIVER will comply with all the terms and conditions of this Agreement.

Delivery and return:
1. The LESSOR agrees to rent and the RENTER agrees to take the vehicle described in the Rental Agreement on the terms and conditions as set out in this Agreement. Cars are rented for days (24 hours).
2. The rent shall start and end at the place or address specified by the LESSOR in the Agreement.
3. The RENTER undertakes to return the vehicle with its registration card, keys, all tyres, tools, radio and other accessories in the same condition and without any apparent defects as when received, ordinary wear and tear excepted, to the place and on the date set down in the Rental Agreement. The rented car must be returned at time set down in the Rental Agreement (no later then 3 hours). Otherwise, the RENTER is to pay for the next day of rental.
4. Any excess of the agreed rental period shall require the prior consent of the LESSOR. Otherwise the LESSOR shall be entitled to take possession of the car Renters expense and to charges for the additional use of the car.

Charges:
1. RENTER shall pay any charges shown on the front page of the Agreement or mentioned in the current tariffs.
2. The RENTER will pay the LESSOR on demand all charges due under this Agreement, plus Value Added Tax or other taxes payable and required by the Polish law.
3. The RENTER should own and be able to present a valid credit card.
If the credit card has been issued by a Polish bank, the LESSOR is entitled to require from the RENTER PLN 7000,- (in words: seven thousand zlotys) as a deposit. The deposit can be paid by cash, bank transfer, certified cheque or another credit card. The deposit can be used by the LESSOR in any time of lasting this agreement when the RENTER does not obey the agreement.

Conditions of use:
1. The rented car may be driven only by the drivers named in the Rental Agreement, cars rented by firms only by permanently employed professional drivers or other persons authorised by the firm.
A condition for such use by authorised third parties shall in all cases:
- to make sure that driver is in possession of a valid driving license (international driving - applies to foreigners) for a minimum period of 12 months, that he is minimum 21 years (Group 0, A-B), 25 years (Group C and over).
- To inform the driver about the rental conditions and that he will acknowledge to comply with the same.
2. The vehicle will not be driven by any person who is under the influence of alcohol, hallucinatory drugs, narcotics or barbiturates.
3. The RENTER and driver shall comply with all statutory rules for the use of the rented car.
4. The RENTER must not in particular a) actively engage in motor sport events, b) travel abroad without the written approval of the LESSOR, c) carry goods or other values contrary to the laws of Poland.
5. During the rental term, the RENTER shall regularly check the oil and water level and the tyre pressure. Failure to comply will make the RENTER liable for any damage resulting there from. Before its return, the car must be a fully refuelled, otherwise RENTER will be charged for missing fuel plus service.

Accidents:
1. In every case of an accident (with or without damage to the vehicle) the RENTER shall notify the police and insist on the accident injury being recorded by the police. The LESSOR shall be informed immediately. Evidence (witnesses, traces) must be secured and names and addresses of the parties involved be taken down, and everything must be done which will help to properly discover the cause of the accident and its chronology.
The RENTER shall not acknowledge fault or prejudice the settlement of any liability claims by making payment or performing any other acts implying the acknowledgement of damage and or fault (risk of loss of insurance coverage).
2. If for any reason the vehicle described overleaf, or any other vehicle from time to time begin the subject matter of this agreement, shall become unroadwrothy for whatsoever reason, the LESSOR shall have the right at its discretion and not otherwise, to replace the vehicle with an alternative vehicle of similar seating capacity and performance, but if no such alternative vehicle is available or if the LESSOR shall decline to provide an alternative vehicle, then there shall be credited to the RENTER such portion of any hire charges paid by him as represents the unexpired portion of the hire period, but he shall have no other claim of any kind whatsoever against the LESSOR.
3. The LESSOR accepts no responsibility for delays and or consequential losses from breakdown or from other circumstances.

Repaires:
1. For eventual repairs the nearest specialised repair shop must be consulted. Any repairs exceeding the amount of DM 200 shall require the approval of the LESSOR.
2. The RENTER will immediately inform the LESSOR of fault in the vehicle and will not use the vehicle whilst it is in an unroadworthy condition.

Insurance:
1. The Lessor provides insurance coverage for persons using the vehicle with it's permission (and not otherwise) in accordance with an automobile liability insurance policy, which is available for inspection.
2. The vehicle is insured against third party liability by a third party insurance policy, a copy of which is inserted to wallet. Collision Damage Waver (CDW) and Theft Protection (TP) are optional.
The LESSOR offers both options at the fixed daily rates. If the RENTER declines to purchase of:
- CDW - Renter's responsibility for damage to the rented vehicle or its accessories is limited to the entire value of vehicle;
- TP - the Renter is liable in the entire value of the car.
Insurance does not cover any damages and theft of the vehicle in case:
- of driving the vehicle without the Lessor's permission;
- the driver runs away from the place of an accident;
- of leaving the keys and registration card of hired vehicle in the interior of the rented car.

Attention!
In case of a damage or theft of the rented vehicle - a non waivable excess of 300 DM + 22% VAT will be applied. In case of a theft of the rented car - original keys and registration card of the rented vehicle must be returned to Local Rent a Car - Poland Tourist Service Sp. z o.o. If not - the RENTER covers the whole value of the stolen car.

Other Information:
1. The rental fee consists of: unlimited mileage (if the agreement does not determine differently), insurance, maintenance, breakdown service, engine oil.
2. All rental charges are subject to 22% VAT tax.
3. Additional agreements or annexes to the Rental Agreement shall require the Lessor's approval in writing.
4. The RENTER agrees to storage of his personal data. In case of default of payment or return of the car under conditions in violation of this agreement of presentation of false personal documents, the personal data can be forwarded to a warning file.
5. Venue for both parties and for all claims arising from and in connection with this agreement shall be at the Lessor's domicile if the RENTER is a merchant party or has not statutory venue in Poland.
6. All disputes which may arise out of or in connection with this agreement shall fall within the exclusive jurisdiction of the Court having responsibility for such matters at the capital of country of residence of the LESSOR.
