Biography

| Rob has engaged in a commercial trial and antitrust practice since 1983. His experience includes antitrust, securities, professional liability, class action, regulated industry, and general business controversies both in federal and state trial and appellate courts. Rob also counsels clients on antitrust matters, including mergers and acquisitions. His clients include computer, insurance, electric utility, health care, energy, transportation, telecommunications, and entertainment companies. Rob also serves as Co-Managing Partner of the firm's 140-lawyer Dallas Office and serves on the firm's Management Committee. |
Representative Experience

- Secured trial verdict in federal court in San Antonio, Texas in nationally-recognized antitrust litigation brought by independent video retailers against Blockbuster and the principal Hollywood movie studios
- Secured denials in actions in California and Texas of motions to certify national classes of approximately 25,000 independent video retailers against Blockbuster and the principal Hollywood movie studios claiming violations of federal and California antitrust and trade practices statutes
- Secured denials of motions to certify national classes of tens of thousands of workers' compensation insureds in federal and state court class actions across the country against Liberty Mutual Insurance Company and other workers' compensation insurers
- Secured dismissals of actions against Continental Airlines and Southwest Airlines in class actions pending in federal courts in New York, New Jersey, California, and Texas in which plaintiffs sought in excess of $100 million in federal excise tax refunds
- Secured multi-million dollar settlements for Hicks, Muse, Tate & Furst, Inc. in contract and business torts action against two national REITs stemming from the $2.1 billion sale of the real estate assets of Sears, Roebuck & Co.
- Secured dismissals of claims against several principal defendants in the class action Charitable Gift Annuity Antitrust Litigation in federal court in Wichita Falls, Texas, in which plaintiffs sought hundreds of millions of dollars in damages
- Secured dismissals of claims against Chicago Title Insurance Company, the largest writer of title insurance in Texas, in the Texas Title Insurance Antitrust Litigation; plaintiffs sought to certify a class of hundreds of thousands of purchasers of title insurance and related services and seek hundreds of millions in damages from the principal title insurance underwriters in Texas
- Secured a multi-million dollar trial verdict for the Life Insurance Company of Georgia against Electronic Data Systems in a computer software dispute; the Fifth Circuit later affirmed the judgment
- Secured successful settlement for Cyrix Corporation in a several-hundred-million-dollar dispute with Texas Instruments over TI's manufacture of IBM-compatible microprocessors for Cyrix
- Secured a multi-million dollar jury verdict in state district court in Dallas County, Texas for the manager of rap artist Vanilla Ice against the artist's former promoter
- Secured dismissal of securities fraud claims against Coopers & Lybrand in the Northern District of Texas and an affirmance by the Fifth Circuit in a case in which plaintiffs sought hundreds of millions of dollars in damages
- Successfully defended Tatung Corporation of Taiwan at trial against a multi-million dollar claim brought by a former distributor of Tatung products
- Member of Vinson & Elkins trial team in the ETSI Antitrust Litigation that obtained a $1.1 billion jury verdict against the Santa Fe Railroad
