Terms and Conditions

i-Dish, LLC is an Authorized Retailer for DISH Network/EchoStar Communications Corporation. By placing your order by phone or via the Internet with i-Dish (www.i-dish.com), you are agreeing to the following terms and conditions governing your purchase of an installation certificate (certificate number), merchandise, and/or services from i-Dish. By placing your order, you are creating a legally binding contract with i-Dish. If you do not agree to these terms, request a refund of your unused installation certificate with i-Dish immediately.

Definitions. As used herein, the word "agreement" shall mean the Order Form you just completed and these Terms and Conditions of Purchase (including any terms incorporated by web address). The words "I", "you" or "your" shall mean the person completing this transaction.

Payment. I state that I am the authorized cardholder indicated on the Order Form or that I have been authorized by the cardholder to use the credit card indicated on the Order Form. I understand that upon submitting my order by phone or internet my card is immediately charged in the amount of $49.99 for the activation fee.  In the event the credit card on the Order Form is dishonored, rejected or later contested for any reason, I agree to pay the amount indicated on the Order Form to i-Dish.

Purchase Conditions.

1. You agree that you and your household will be first time residential DISH Network subscribers. (This means that no member of your household has ever had account history with DISH Network.)

2. You agree to activate your account with DISH Network within twenty-one (21) days of the order date.

3. You agree to a minimum monthly programming package of $24.99 for one year or two years (depending on equipment configurations) and agree to not disconnect such service for any reason during the twelve-month period on any receivers. (applies only to the Free Dish promotion)

4. You agree to not activate under any other promotional offers such as "Club Dish".

The Order. Upon acceptance of your order by i-Dish and receipt of your $49.99 deposit/activation fee (refunded on your first month's programming bill), i-Dish will process your order and provide you an installation certificate number for free standard professional installation to be scheduled by you and performed by Dish Network Service Corporation. Termination of Service. (For Free Dish promotion only) For 12-month programming purchase, if service is terminated or downgraded prior to 12 months, DISH Network will apply a cancellation fee of $240. For 24-month programming purchase, if service is terminated or downgraded (below $24.99) prior to 24 months, DISH Network will apply a cancellation fee of $360 during the first 12 months, or $180 if cancelled during the second 12 months. Service agreement will be provided by installer.

DISH Network Subscription. I understand that i-Dish is not DISH Network but is an authorized DISH Network dealer/reseller. All installations are performed by Dish Network Service Corporation.  I have read, understand agree to the terms of the i-Dish Service Disclaimer found here. I further agree to be bound by the terms of the DISH Network Residential Agreement found here.

Refund Policy. i-Dish.com offers a full, no hassle refund of the $49.99 activation fee.  To cancel an order simply contact i-Dish during their normal business hours of 8 am to 8 pm Monday-Friday or 8 am to 5 pm Saturday.  A customer service representative will approve the cancellation of the order and the $49.99 will post back to your credit card within 3-5 business days.  If an appointment  has been scheduled for installation it is your responsibility to contact Dish Network Corporate (800-333-3474) to cancel said appointment.   No refunds are available after your system has been installed and activated.

Default. (For Free Dish promotion only) In the event you default on your obligations under this agreement, you authorize i-Dish to charge your credit card $295.00. In the event you contest this amount or the charge is dishonored or rejected for any reason, i-Dish shall have the right to report the matter to national credit reporting agencies and may pursue any other legal remedy. You further agree to pay any 3rd party collection costs and/or credit card dispute charges for any fees charged by our processor/merchant bank by your disputing any charge directly with your credit card company ($30 minimum charge per dispute).

Warranty. i-Dish hereby disclaims all warranties, whether express or implied, including the warranties of merchantability and the warranty of fitness for a particular use. i-Dish does not warranty or guaranty any DISH Network receivers or components and all warranty work must be done in accordance with the manufacturer's warranty found here.

Limitation of Liability. In no event shall i-Dish be responsible for incidental or consequential damages arising by reason of your purchase of merchandise or services from i-Dish. i-Dish's maximum aggregate liability to you arising by reason of this transaction shall be the amount paid by you to i-Dish for the certificate number.

Indemnity. You agree to indemnify and hold harmless i-Dish against any costs, fines, claims, damages, charges, or fees (including reasonable attorney's fees) arising by reason of your purchase, the installation or use of the satellite equipment you are purchasing.

Notices. If notice is required, you agree to notify i-Dish by e-mail at customerservice@i-Dish.com or toll-free at 1-800-434-7451. Notice will be deemed given when received by i-Dish. i-Dish will not be liable for problems caused by misdirected or undelivered e-mail. i-Dish will direct all correspondence to you at the postal address or email address provided on the Order Form unless you notify us of a change of address.

Enforcement of This Agreement. This agreement shall be governed by and interpreted in accordance with the laws of the State of Utah, excluding its conflict of laws provisions. Any dispute under or in connection with this Agreement or any of the transaction contemplated herein shall be subject to the exclusive jurisdiction of and the personal jurisdiction within the state and federal courts within Salt Lake County, Utah. You hereby waive any objection you may have to personal jurisdiction in such courts. In the event you default on the terms of this agreement, you agree to pay to i-Dish all costs, fees and expenses including reasonable attorney's fees.

Use of Electronic Records. I agree to i-Dish's use of electronic records to evidence this agreement. I understand that I have the right to not consent to the use of electronic records by not transacting business with i-Dish. In such event, this will be null and void. My consent applies only to this transaction. I hereby waive any objection I may have to i-Dish's use of electronic records in court should it be necessary for i-Dish to enforce the terms of this agreement.

Miscellaneous Matters. This agreement constitutes the entire understanding of the parties with regard to your purchase. All prior representations, oral or written, and all prior agreements, oral or written, having been merged into this agreement. This agreement or any portion hereof shall not be construed against the drafting party by reason of that party having drafted the agreement or portion hereof. If any provision, paragraph, or subparagraph of this agreement is adjudged by any court of law to be void or unenforceable, in whole or in part, the rest of the agreement shall remain in effect. The parties agree that in such event, the offending clause will be replaced with a provision or provisions having the same economic effect. This agreement shall be binding on, and shall inure to the benefit of, the parties to it and their respective heirs, legal representatives, successors and assigns. In all matters contained in this agreement, time is of the essence.

Earthlink DSL Offer. Offer expires 6/30/04. For new EarthLink and new and current DISH Network customers who subscribe to either America�s Top 120, America�s Top 180, DISH Latino Dos, DISH Latino Max or America�s �Everything� Pak. DISH Network customers who sign up for EarthLink DSL for 12 consecutive months will receive a $5.00 discount on the monthly EarthLink bill and a $5.00 discount on the monthly DISH Network bill for 24 months from DSL activation. A valid major credit or debit card is required (American Express, Discover, Visa, or Mastercard). EarthLink services are billed monthly against customer�s credit card. Discount discontinued if either service is terminated before the end of the 24 months. Early EarthLink termination fees apply. Not available in all areas. Some restrictions apply. Offer may not be used in conjunction with any other offer. Standard DSL Installation kit included. Shipping and handling charges not included.
