Terms and Conditions.
The Corporate Sportsman, Inc. (TCS) owns Cabo
San Lucas Villas website. (CSLV)
Reservations and Deposits
- We accept reservations with a valid credit card check or wire transfer
as a guarantee of deposit. A deposit is required upon receipt of lease
agreement. Final payment is due 45 days prior to your departure.
Itinerary and Documents - Itineraries and documents are issued prior to departure. These documents
will not be sent until full payment and signed documentation is received.
Cancellations and Refunds
- All reservations payments are non-refundable unless TCS/CSLV can re-rent
the same property for the same period of time. Holiday payments are
non-refundable regardless of re-rental. Reservations may be re-scheduled
for up to one year after original reservation.
Modifications of these Terms and Conditions
- TCS/CSLV reserves the right to change this Agreement at any time by
revising the terms and conditions herein. User is responsible for
regularly reviewing these terms and conditions. Continued use of this Web
site following any such changes shall constitute the User's acceptance of
such changes.
Not Included
- Expenses and items not mentioned including but not limited to air
transportation, tips for house staff, meals, beverages, travel insurance,
telephone calls, laundry service and any items of a personal nature.
Indemnity
- As a condition of use of this Web site, the User agrees to indemnify TCS/CSLV
and its suppliers from and against any and all liabilities, expenses
(including attorneys' fees) and damages arising out of claims resulting
from User's use of this Web site, including without limitation any claims
alleging facts that if true would constitute a breach by User of these
terms and conditions.
Responsibility
– The vendors that provide activities, tours, transportation, chef
services etc. and owners of accommodations for TCS/CSLV are independent contractors and
are not agents or employees of TCS/CSLV. Each guest acknowledges that
accommodations, activities, tours, services, roads, traffic laws,
transportation, sanitation (water and food), building standards, insurance
practices, and medical care are not as highly regulated as those in the
United States. Guests may encounter the following risks: slippery floors
and stairs, especially when wet, precipitous drop-offs at or around some
of the residences, unfenced pools, poorly designed or faulty electrical,
plumbing and gas systems, dangerous driving conditions, poorly maintained
or equipped vehicles, and dangerous stairs or pathways, Some activities
that guests engage in are especially dangerous, and include, four wheeler
(ATV) rentals, horse-back riding, scuba diving and snorkeling, deep-sea
fishing, golfing, swimming, and surfing. The above lists are not
all-inclusive, but simply point out some of the hazards of vacationing in
Mexico. Therefore, each guest agrees that he/she is voluntarily
participating in any and all activities, risks, and use of the
accommodations, and hereby assumes all risk of injury, illness, damage or
loss to person and property that might result, including, without
limitation, any loss or theft of personal property.
Limitation of Liability
– By booking this vacation, you acknowledge that in all events TCS/CSLV
shall not be liable for any consequential damages and that the sole extent
of TCS/CSLV liability shall never exceed the amount actually paid by you
to TCS/CSLV. Each guest agrees on behalf of himself/herself (and your
personal representatives, heirs, executors, administrators, agents, and
assigns) to release and discharge TCS/CSLV, its employees, agents,
officers, directors, and shareholders from any and all claims or causes of
action (known or unknown) arising out of the negligence of TCS/CSLV. This
includes, without limitation, injuries or damages arising from TCS/CSLV
negligence which may occur on or about the accommodations, any activity
engaged in by the guest, including but not limited to all activities
listed above, and any negligent inspection, supervision, instruction,
and/or maintenance of TCS/CSLV, defect in vehicles, breakdown in
equipment, accident, sickness, Acts of God, strikes, theft, delays,
inconvenience, construction, loss of personal enjoyment, cancellations or
changes in itineraries or schedules.
Venue for disputes
- By booking your vacation with TCS/CSLV you acknowledge and agree that
the venue for any dispute or claim that you may make regarding vacation
arrangements made by TCS/CSLV shall be made in the country of Mexico.
