NOTICE OF MEETING OF THE VALUE ADJUSTMENT BOARD
The meeting of the Value Adjustment Board of September 28, 2004, to certify the Tax Roll for 2004, has been rescheduled to October 5, 2004. The meeting will be held in the Governmental Center, 301 North Olive Avenue, 6th floor Commission Chambers, West Palm Beach, at 9:00 a.m.
VALUE ADJUSTMENT BOARD HEARINGS
The Value Adjustment Board hearings of September 30, 2004, have been canceled. Petitioners will be notified of a new hearing date and time.
The Value Adjustment Board (VAB) offers County property owners an opportunity to contest the assessed value set by the Property Appraiser of their real or tangible property or to appeal the denial of an exemption or classification. Property owners are notified each August by the Tax Collector of the current year's assessed and market values in a Truth in Millage (TRIM) notice that also shows the prior year's tax and the current year's tax with and without budget changes.
- Property owners may request an informal conference with the Property Appraiser; if still dissatisfied with the assessment, owners have 25 days following mailing of the TRIM notice to file a petition to the Value Adjustment Board with the Clerk.
- A $15 filing fee is charged with certain exceptions and evidence must be presented to the Property Appraiser prior to the hearing date.
- Petitioners are notified by mail of their hearing date 25 days in advance.
- A petitioner bears the burden of proving the assessment is excessive or unjust.
- Hearings are conducted by Special Masters who meet state professional qualifications.
- The Special Master's rulings are presented to the VAB for confirmation and a final decision notice is mailed to each petitioner by the Clerk.
- Taxpayers who disagree with the Special Master ruling may appeal the VAB decision by initiating a suit in the Circuit Court no later than 60 days from the Clerk's mailing of the final decision form.
- Petitioners who are successful in reducing their assessments will receive an adjusted tax bill. If their taxes were paid, any overpayment will be refunded by the Tax Collector.
The Palm Beach County Value Adjustment Board hears about 4,200 petitions each year during November and December. The five-member board is composed of three members of the Board of County Commissioners and two members of the County School Board. A commissioner serves as VAB chair. The Minutes Division records the Adjustment Board proceedings and maintains those records.
