• If any debt collector threatens the debtor, that might result in a) Arrest
of any debtor or, b) Garnishment of any wages of any debtor
• Communicating by telephone without disclosure of the name of the business
or company of the creditor is illegal. The creditor should also disclose personal
name and be honest. Any long distance telephone call should not be on the debtor’s
expenditure.
• The creditor should send a written notice within 30 days of the first communication
with the debtor. A copy of that notice should be sent to him every six months
so long as the collection procedure continues.
• It is to be noted that the creditor cannot take any legal action against
the debtor’s inability to pay unless additional payment or a new agreement is
on the cards. This period is for 14 days from the time the statement is issued,
unless otherwise indicated by the creditor.
