you agree to be bound by the Terms and Conditions set forth below.
1. Provider
Europe-Mountains is a brand product of the Provider: Old Town Apartments
Sp. z o.o., a company incorporated in Poland with limited liability.
Europe-Mountains is certified as Travel Agency (registration number
576) and holds OCE insurance by Warta SA;
2. Hotel and apartment
Hotel and apartment are accommodation institutions listed on www.europe-mountains.com,
which the User reserves on the basis of the information on www.europe-mountains.com
web site and orders through the Service;
3. User
User is an individual or legal entity that uses the Service;
4. On-Line Service
On-Line Service is providing assistance in accommodation, car and travel
reservations via the web site www.europe-mountains.com;
5. Rights and obligations of the Provider
The Provider does not take over liability for any damage caused by cancellation
or change of reservation on the part of the Hotel. In such case the
Provider will provide an effective assistance defending the User's case,
being ready to find other accommodation of comparable price, standard,
and location. The Provider is authorized to block the User, who at any
time in the past violated the valid Terms and Conditions of the Contract
from the provider;
6. Security of Personal Identifiable Information (PII)
The Provider guarantees the security of the personal information about
the User. The provider uses certified, 100% Secure Socket Layer (SSL)
encryption (credentials by Comodo Group) which effectively restrains
access to private information from a third party and ensures that your
PII is securely and quickly authorized.
The Provider uses the User's PII only for the purpose of responding
to and fulfilling the requests for Europe-Mountains.com travel products
and services. It is shared solely with authorized travel service providers,
and only as necessary in order to complete a transaction that you specifically
request;
7. Rights and Obligations of the Hotel
The Hotel is responsible for accuracy of information delegated to the
Provider;
8. Rights and Obligations of the User
When reserving the accommodation the User must supply the Provider with
their Credit Card details valid until the User's departure date from
the reserved Hotel. The User does not have to provide their credit card
in case the Hotel permits prepayment.
The User accepts that prices, restrictions and availability of products
and services may change without notice. The User must not use a false
name when using the Service;
9. Indemnification
You agree to indemnify, defend and hold harmless Europe-Mountains.com,
its officers, directors, employees, agents, licensors, suppliers and
any third party information providers to the Service from and against
all losses, expenses, damages and costs, including reasonable attorneys'
fees, resulting from any violation of these Terms and Conditions (including
negligent or wrongful conduct) by you or any other person accessing
the Service;
10. Limitation of Liability and Disclaimer
The Provider does not guarantee the accuracy, availability, quality,
timeliness, completeness, performance or fitness for a particular purpose
of any part of this site, any content or any accommodation, products
or services available via this site or guarantee that this site is free
from viruses, worms or Trojan horses. We undertake utmost effort that
our information is unparalleled in the amount of information details
and constantly reliable;
11. Reservation and Deposit Conditions
Reservation and deposit conditions of the Hotel accommodation vary.
The precise formulations are available at the respective hotel pages.
12. Prices and Conditions of Payment
Hotel rates are presented on hotels' webpages as according to hotels'
offers.
The User pays to the Provider charge for using the Service. The User
pays the contracted price directly to the Hotel usually when they check
out. The payment is made with Credit Card, cash or by banking transfer.
The basis currency for payment is Euro (EUR) for countries situated
in the European Monetary Union (Austria, France, Italy, Germany, Spain)
and national currencies for countries outside EMU (Poland, Scotland,
Slovakia, Switzerland). Payments in foreign currencies are done according
to the current exchange rate.
13. Reservation Changes and Cancellation Policies
Reservation changes are made for free. All reservations are subject
to cancellation policies. The individual Hotel cancellation policies
are published on individual hotel pages and posted on every confirmation
letter. The cancellation fees are taken by the Provider from the Client's
credit card. In case the User cancels before the cancellation policy,
the Provider is entitled to demand a flat cancellation fee 25 EUR.
14. Links to Third-Party Sites
This Web site may contain hyperlinks to Web sites operated by parties
other than Europe-Mountains.com. Such hyperlinks are provided for your
reference only. The Provider does not control such Web sites and is
not responsible for their contents.
15. Force Majeure
The Provider cannot be held accountable for damages and changes to reservations
caused beyond the control of the company (including and without limitation,
acts of God, explosions, floods, tempests, fires, accidents, war or
threat of war, sabotage, insurrection, civil disturbance or requisition,
sickness, quarantine, government intervention, weather conditions or
other outwards occurrences).
16. Governing Law
This Agreement and its performance shall be governed by the laws of
the state of Poland without giving effect to applicable conflict of
laws provisions. You consent and submit to the exclusive jurisdiction
of the courts located in Warsaw, Poland, in all questions and controversies
arising out of your use of the site and this Agreement.
17. Changes to the Terms and Conditions of Use
The Provider reserves the right to do changes to the Terms and Conditions
of Use. If a provision of these Terms and Conditions turns invalid,
it will not influence validity the Terms and Conditions as the whole.
These conditions were given publicly and are valid from June 4, 2004
onwards.
