Use of our Site & services

1. You will not:

• Illegal activities. You agree not to use htmlforms.com in a manner that is prohibited by any law or regulation, or to facilitate the violation of any law or regulation. You acknowledge that prohibited conduct includes, but is not limited to, use of htmlforms.com to invade the privacy of third parties, impersonation of htmlforms.com personnel or other parties or entities, or transmitting abusive, profane, libelous, slanderous, threatening or other harassing material; this also prohibits any links and/or directions to such material.
  
• You agree not to use htmlforms.com for any unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable means, including but not limited to your use of content stored on forms your create or the text in the usernames you create. Any forms in violation of this are subject to deletion & any usernames in violation of this will be edited @ our discretion in which case you will be alerted by email.
  
• You are expressly forbidden from attempting to defraud us in any way or attempt to hack any part of htmlforms.com or gain access to any other users account or credits. You are also forbidden from attempting other attacks on our service including but not limited to: DDOS attacks, planting viruses or trojan worms; or attempt anything that may have a negative affect on our service to other users or as a whole.
  
• You may not include any content including but not limited to: text and/or images on hosted forms in a manner that it appears you are attempting to impersonate and/or insinuate you represent htmlforms.com in any way.
  
• You agree not to use htmlforms.com in connection with the sending of unsolicited electronic mail messages (SPAM), whether commercial or not, to a large number of recipients. You agree not to send unsolicited mass mailings from another service, which in any way implicates the use of htmlforms.com or results in the use of htmlforms.com resources.
  
• It is prohibited to copy or use any source code (HMTL and scripts) or parts of the source code generated by htmlforms.com or any other text and/or images on the Site.
  
• Liability for Breach. For each violation by you of this Section that inflicts htmlforms.com financially or has the potential to damage our business in any way you agree to pay htmlforms.com damages to compensate for the lost goodwill such a violation causes, but, where warranted, htmlforms.com may waive all or part of the applicable charge. Payment by you under this Section shall not prevent htmlforms.com from seeking to obtain other legal remedies against you, including other damages or an injunction.

2. We reserve the right to change the features for HTML Forms Free whenever we like without notice.

3. We reserve the right to put a limit on the number of pro hosted forms you may host with us in relation to the pro hosted yearly subscription and/or offer different price/limit packages; however, all current subscriptions will be honored until the end of the current subscription. In the case that we add a limit or change to offering packages with different limit options; at the end of your current subscription, to make sure none of your current pro hosted forms get deleted you would need to subscribe to a package that has a limit of more than your current pro hosted form amount.

4. You understand that fees for credits & pro hosted yearly subscriptions are non-refundable.

5. You understand the pro hosted yearly subscriptions are for 365 days.

6. You will take full responsibility for the contents of your username & the forms you create excluding any additions htmlforms.com adds to your form pages and/or code & understand that @ the bottom of each hosted forms page we may put very small text explaining that the contents of the page do not necessarily reflect the views, opinions or ideals of htmlforms.com & will also explain how they can report the page if they think it is in violation of these terms of service.

7. In "Step 4" of HTML Forms Free: Hosted Forms, you agree to answer the question honestly of what your site is related to that you will be using the form for, using the provided selections.

Advertisements & related matter

HTML Forms Free: Hosted Forms. You understand that all these forms will be supported by advertising (including the "thank you" page the user sees after they submit the form) & we reserve the right to make changes or make additions to the advertisements shown on these pages without notice. These pages may also contain text, small images and/or links telling the user that the form was created with htmlforms.com, most likely @ the bottom of the page. You also understand that you will not receive any compensation whatsoever from these advertisements; additionally, the advertising displayed may include advertisements for competing products/services/sites.

HTML Forms Pro: Hosted Forms. You understand that to prevent advertisements from being shown on these pages you will need to purchase a pro hosted yearly subscription (for a very minimal fee); if you do not keep this subscription current any hosted forms not displaying advertisements are subject to deletion. We reserve the right to make changes or make additions to the advertisements shown on these forms without notice. You also understand that you will not receive any compensation whatsoever from these advertisements; additionally, the advertising displayed may include advertisements for competing products/services/sites.

Compliance with law

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service.

Privacy Policy

The information collected and used on the Site is governed by htmlforms.com's Privacy Policy.

Disclaimer

THIS SITE AND ALL CONTENTS OF THE SITE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOUR USE OF OUR SERVICES SHALL BE AT YOUR OWN RISK. WE SHALL NOT UNDER ANY CIRCUMSTANCES BE RESPONSIBLE FOR ANY LOSS OR DAMAGES OF ANY KIND UNDER ANY LEGAL THEORY ARISING FROM YOUR USE, REGISTRATION TO USE, OR INABILITY TO USE, OUR SERVICES, EVEN IF WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to defend, indemnify and hold htmlforms.com harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site.

Termination

This Agreement is effective unless and until terminated by either you or htmlforms.com. You may terminate this Agreement at any time; htmlforms.com also may terminate this Agreement at any time. Htmlforms.com also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in htmlforms.com's sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or htmlforms.com, you will lose access to all of htmlforms.com & your account deleted including all your hosted forms & any credits you may have & will receive no compensation whatsoever unless otherwise agreed to by both parties.

Governing Laws

You agree that this Agreement & your use of this Site will be governed by the laws of the state of Western Australia, Australia. You may also be subject to other local, state, national, and international laws. You expressly agree that any dispute and/or claim arising out of or in connection with your use of and/or inability to use the Site shall be submitted to individual arbitration without resort to litigation before any state or Federal Court, and that such arbitration shall be heard in the City of Perth, Western Australia, Australia.

Submission of ideas

You may submit ideas, feedback & suggestions to us but you understand that in doing so you give us full permission to use the suggestion/idea without any compensation to you whatsoever.

Miscellaneous

Whilst we will take all steps necessary to protect your data & personal information from unauthorized third parties but we will not be held responsible if it is obtained by any third party by use of but not limited to: hacking, viruses, trojan worms or any other related attacks or vulnerabilities.

We reserve the right to change these terms of service and/or our privacy policy, at which time you will be notified via email of the respective changes/modifications; if you do not agree with the new TOS and/or privacy policy then you will be required to respond to the email & ask us to terminate your account from our Site.
