* By entering this promotion, each passenger is deemed to have read and accepted to abide by these terms and conditions, all entry instructions and any other instructions and conditions which may from time to time be as stipulated by THAI shall altogether form an integral part of these terms and conditions.
* Only in-bound flights to Thailand with scheduled flight times in excess of 1:30 hours are eligible for entry.
* Prize winners will be drawn and announced onboard every in-bound flight to Thailand.
* Winners will receive a return ticket for travel from their country of residence where THAI operates, or the nearest departure point served by THAI, to Thailand for the same class of travel as their winning ticket. Passengers must bear their own transportation costs to the designated departure airport.
* Winners who reside in Thailand will receive a return ticket departing Thailand for the same route and same class of travel as their winning ticket.
* By the completion of the entry form, each passenger hereby represent and warrant that all information provided by himself/herself at the time of filling out the entry form is complete, accurate and valid, and shall at all time remain the same in order to be eligible for awarding of the prize under this promotion.
* All entries and related information shall be kept by THAI and will not be returned for any reason.
* To the extent permitted by applicable law, THAI shall be entitled to use any or all information provided by the passenger in the respective entry form for any legitimate purpose including marketing or promotion, direct marketing and profiling. The passenger expressly consents to the above and further consents to the transfer of the information to any location or third party located within and/ or outside of Thailand.
* If an eligible passenger becomes a winner, he/she hereby agrees to:
(a) allow and consent THAI to use his/her name and likeness as well as any other information about himself/ herself without compensation for the purposes of marketing and communication of THAI; and
(b) if requested by THAI, participate in promotional events in connection with this promotion.
* The lucky draw will be conducted on board while flying over Thai territory. The name of winner will be unofficially announced prior to landing on any airport in Thailand. The name of winner will then be verified by the senior cabin attendant to ensure that the prize certificate is correctly issued.
* Winners will be officially announced at www.thaiairways.com 15 days following each lucky draw throughout the promotional period.
* Prize certificates will be mailed directly to winners within 60 days after the lucky draw.
* The winner’s prize certificate and passport (or personal identification card) must be presented at any THAI’s ticketing Office for ticket issuance. Identification is required at the time of issuance.
* Prior to issuance of the ticket or redemption of the prize, the winner shall be subject to all mandatory federal, state, local and foreign income or prize tax obligations, including, but not limited to, duties, levies or fees of whatever nature applicable to the redemption of the prize.
* Prize tickets are valid for travel on THAI operated flights between 15 April and 15 July, 2005 only. Confirmation of booking will be subject to seat availability.
* Prize certificates and tickets are non-transferable, non-negotiable, and non-redeemable for cash.
* Any expenses incurred by the prize winner during travel will be borne by the winner.
* Prize tickets are not eligible for mileage accrual for Royal Orchid Plus awards or benefits.
* THAI reserves the right to substitute an alternate prize of equal value as deemed necessary or to cancel or change this promotion without prior notice.
* This promotion is offered exclusively to the above-mentioned eligible passengers, and in case of any fraudulent actions or documents, THAI reserves the right to commence legal action.
* THAI reserves the right to cancel or change any of this promotion at any time by giving a seven-day prior notification before any such change, withdrawal or cancellation. However, in some cases (at THAI’s sole discretion), the prior notification may not be possible and will therefore not be required.
* THAI reserves judgment on all matters with regard to competition rules and awarding of prizes.
* To the extent permitted by applicable law, in no event shall THAI be liable for any incidental, indirect exemplary, special or sequential damages whatsoever that may be suffered or incurred by the winner as a result of the use of the information collected from his/her for the purpose of marketing or communication of THAI.
* In any event, each passenger hereby agrees that THAI’s sole limited liability towards the eligible passenger and the winner of this promotion shall not exceed the value of the awarded prize ticket at any time and for any reason.
* Winners are subject to local laws and restrictions, including reporting any prizes or taxes to local governments, as required by law.
This promotion shall be subject to all applicable laws, rules are regulations, and to such approval by any governmental agencies or authorities as may be required. This promotions is "VOID WHERE PROHIBITED", and is not available to resident of jurisdictions where the promotion is prohibited.
This promotion is governed by, interpreted, and construed in accordance with the laws of the Kingdom of Thailand.
