Provider
Stay-Prague.com is a brand product of the Provider: Old Town Apartments
s.r.o., a company incorporated in the Czech republic with limited liability. Provider
is certified as Travel Agency;
2. Rights and obligations of the Provider
The
Provider does not take over liability for any damage caused by cancellation or
change of reservation on the part of the Hotel. In such case the Provider will
provide an effective assistance defending the User's case, being ready to find
other accommodation of comparable price, standard, and location.
3.
Security of personal identifiable information (PPI)
The Provider guarantees
the security of the personal information about the user;
The Provider uses
your PII only for the purpose of responding to and fulfilling your requests for
Stay-Prague.com travel products and services.
The Provider will only share
your PII with our authorized travel service Providers, and only as necessary in
order to complete a transaction that you specifically request.
4. Rights
and obligations of the user
When reserving the accommodation the user must
supply the Provider with their credit card details valid until the user's departure
date from the reserved hotel. The user does not have to provide their credit card
in case the Hotel permits prepayment.
The User accepts that prices, restrictions
and availability of products and services may change without notice;

Indemnification
You agree to indemnify, defend and hold harmless Provider,
its officers, directors, employees, agents, licensors, suppliers and any third
party information providers to the service from and against all losses, expenses,
damages and costs, including reasonable attorneys' fees, resulting from any violation
of these Terms and Conditions (including negligent or wrongful conduct) by you
or any other person accessing the service;
6. Limitation of Liability
and disclaimer
The Provider does not guarantee the accuracy, availability,
quality, timeliness, completeness, performance or fitness for a particular purpose
of any part of this site, any content or any accommodation, products or services
available via this site or guarantee that this site is free from viruses, worms
or Trojan horses.
7. Prices and conditions of payment
With the
exception of 10 EUR fee for cancellations, the User does not pay any charge for
Using the Service. The User pays the negotiated price to the Hotel usually when
they check out. Unless specified separately, User's credit card details are required
to guarantee all hotel reservations.
8. Links to Third-Party Sites
This
Web site may contain hyperlinks to Web sites operated by parties other than Stay-Prague.com.
Such hyperlinks are provided for your reference only. Provider does not control
such Web sites and is not responsible for their contents.
9. Force Majeure
Provider
cannot be held accountable for damages and changes to reservations caused beyond
the control of the company (including and without limitation, acts of God, explosions,
floods, tempests, fires, accidents, war or threat of war, sabotage, insurrection,
civil disturbance or requisition, sickness, quarantine, government intervention,
weather conditions or other outwards occurrences)
10. Governing Law
This
Agreement and its performance shall be governed by the laws of the state of Czech
republic without giving effect to applicable conflict of laws provisions. You
consent and submit to the exclusive jurisdiction of the courts located in Prague,
Czech republic, in all questions and controversies arising out of your use of
the site and this Agreement.
11. Changes to the Terms and Conditions
of Use
Provider reserves the right to do changes to the Terms and Conditions
of Use. These conditions were given publicly and are valid from April 1, 2003
onwards.
