INTERNET ACCESS AGREEMENT
This Internet Access
Agreement is entered into effect on the date of activation by and between the individual
whose name appears on the Internet Access Registration Form ("Subscriber") for
the subscriber service and Carolinas Network Company d/b/a Carolinas.net hereinafter
referred to as "CNC" for those services which the "Subscriber" has
indicated on the on their registration form.
Subscriber hereby subscribes to CNC's network services in accordance
with the terms of this agreement. CNC will connect subscriber to CNC's network on or about
the date of receipt of both the CNC's registration form and payment from the customer to
CNC for the subscribed service. Subscriber's access to the CNC network will be provided by
CNC consistent with the Acceptable-Use Policies
attached to this agreement and incorporated herein by reference.
Subscriber acknowledges and accepts that all dialup Internet access
accounts are to be used for temporary dialup connections only and are not to be used for
providing data services or for dedicated connections. Any attempt to maintain a dedicated
connection will result in termination of subscriber's account. Connections that are
inactive for 15 minutes may be disconnected from the network.
Subscriber agrees to pay to CNC any set-up fee and/or monthly fees
associated with above service(s) in accordance with the attached Schedule of Fees, payable
in advance, for connection and use of the network for the number of hours associated with
each service.
Subscriber has read, understands, and agrees to abide by the Acceptable
Use Policies of CNC's Internet connectivity supplier set forth on the attachment to this
agreement. If Subscriber fails to abide by the Acceptable-Use
Policies, CNC reserves the right to terminate this agreement immediately.
The term of this agreement shall be one month, beginning on the date of
activation. This agreement shall automatically renew monthly unless terminated in
accordance with this paragraph. CNC may terminate this agreement at any time without
notice. The Subscriber may terminate this agreement effective on the last day of any
calendar month with 24 hours notice of termination. Subscriber will in all events be
required to pay all service charges due up to the effective date of termination.
Subscriber shall be entitled to a refund of any prepaid service fees, which are unused as
of the effective date of termination. Provisions of this paragraph, 5, shall survive any
termination. CNC reserves the right to change the above terms and conditions without
notice.
CNC will use its best efforts to provide the highest practical level and
quality of service; however, customer agrees that CNC makes no warranties, express or
implied, in connection with the CNC network, Except in the case of a breach of this
agreement by CNC, customer agrees that CNC will not be liable for any loss of service or
other outage, damage to data, software or equipment, or any other loss, damage, expense or
inconvenience. Customer further agrees that under no circumstances shall CNC or Subscriber
be liable for any incidental, consequential, or indirect damages. Subscriber acknowledges
that CNC is not responsible for the nature or content of data available via the CNC
network, and hereby waives all claims against CNC whether in contract, tort, or strict
liability, for damages, losses, or injuries in connection with or arising out of
Subscriber's access to or use of the CNC network. In addition, Subscriber understands,
agrees and accepts that connection and access to the CNC network is authorized for the
Subscriber only.
