We use only a select list of operators whom we know and trust. We visit our operators to check out their boats, facilities and accommodation before recommending them to you. If we discover they are not good enough we simply don't feature them.

To qualify for consideration of this offer, claims must conform to the following conditions:

  • Claims are submitted in writing within 30 days of receiving a 'Confirmation of Reservation Completed' from us
  • The comparative package is a confirmed booking for the same dates
  • The comparative package is considered cheaper if all components of the package are identical, such as, but not limited to:

  2. Hotel
  3. Duration
  4. Diving fees
  5. Services
  6. Equipment hire

Dive The World agrees to consider all claims in good faith.

If the claim is deemed valid then Dive The World agrees to compensate claimants immediately according to the amount advertised in the offer.

Special 'local' prices to residents of Malaysia and 'last minute' prices that may subsequently arise are excluded from this offer.

All judgements of claims are final and binding.

Your Free Shortlist of Options

After you fill out the website enquiry form then you will receive an email with your free shortlist of Malaysia scuba diving options.

The email that we send you contains the best recommendations to match your requirements that you identified in the website enquiry form.

Depending on your requirements, the options may include details of the following choices:

  • Dive Boat(s)
  • Resort(s)
  • Hotel(s)
  • Training Course(s)

Important: These options are held open as available to you only for a short time.

Unfortunately, we cannot guarantee that all options and prices quoted in your Shortlist of Options will be available unless, within 48 hours of receiving your quote you confirm your intention to purchase!

Therefore, you must confirm immediately to avoid disappointment and to prevent the option being unavailable due to another customer booking your desired option.

Confirming Your Intention to Purchase

When you decide upon your desired option, then you can confirm your intention to purchase either by email or fax:

  • Confirm by email
    You can confirm an option from the shortlist by email in one of two ways:
    1. Click on the hyperlink beneath the option that you received in the shortlist email. This will create an email reply addressed to us, containing the code of the option that you have chosen, in the subject field.
    2. Send an email directly to Malaysia@Dive-The-World.com identifying the number (for example "Option 2a" or "Option 5") for your desired option.
  • Confirm by fax
    You can confirm your intention to purchase by identifying your desired option from the shortlist in a fax sent to: +66 (0) 76 344736

    Please ensure that you send us all your details and clearly indicate which option you desire.

Provisional Booking Confirmation

When we receive notice of your intention to purchase, we will send you an email with your provisional booking confirmation, and instructions on how to make your full payment or your Confirmed Reservation Deposit.

Confirmed Reservation Deposit

A Confirmed Reservation Deposit is payable by you, to guarantee your reservation. The non-refundable deposit required is 30% of the total price of your booking.

Confirmation of Reservation Completed

As soon as we receive your Confirmed Reservation Deposit then we shall inform the Operator of your reservation. As soon it is confirmed by the Operator that the reservation process is complete we will send you Confirmation of Reservation Completed.

How a contract is made

Please note that the way a contract is formed on-line for the purchase of a retail product will be different from the way dive packages or courses are purchased through Dive The World.

Our business operates to an agency model. This means that we act as a disclosed agent for third party suppliers, such as dive centres, liveaboard operators or other dive operators, hotels and resorts. We gather all the information and representations from the dive operators and put it all in one place for you. We do our best to verify and update this information as much as is practical. Since we act as agents this means that we have no contractual liability to you in respect of the product. However we may still be liable to you if we have been negligent, if we have misrepresented important information or have been in breach of any other relevant law.

What this means is that the contract for the product is between you and the operator. In most cases this will mean that there are additional terms and conditions governing the contract as each operator will have terms and conditions relating to that product. Please make sure that you have read these terms and conditions before completing your transaction with us. You can easily request them from us.

The technical steps required for a contract to be formed are as follows:

When we place products on the site we are inviting you to make an offer for their purchase. You do not make this offer until you communicate an Intention to Purchase (ie not a general enquiry). Your offer is an offer to purchase the products from the operator for whom we are acting as agent. We are authorised by each of the operators to accept this offer on their behalf. After checking availability we send our "Provisional Booking Held Notification" and in doing so we are accepting your offer and requesting a payment. Once payment is received there is a binding contract between you and your supplier for the product.

Please note that once the payment is received you can only cancel the diving product in accordance with our terms and conditions and those of the operator which may impose cancellation charges. It is your responsibility to ensure you are familiar with any cancellation charges relevant to your booking.

Cancelling Your Booking

If you decide to cancel your reservation 60 days or more before your package commencement date then we will return your payment less the deposit and any bank charges incurred by us.

If you cancel your reservation any less than 60 days before your package commencement date then we retain the right to keep any payments in compensation for potential lost bookings.

Please inform us of any changes to your booking at the soonest opportunity.

Boat Charter Cancellation

For a full boat charter reservation, please cancel 90 days or more before your package commencement date to qualify for a return of monies paid less your deposit and any bank charges incurred by us.

Making Your Final Payment

You make your final payment of your package price (the remaining 70%) to be received by us at least 60 days before your package commencement date. Therefore, please allow time for the transaction to be finalised before this 60 day requirement.

Please note that the number of dives we list in any package is a best estimate based on normal circumstances, not a guarantee. Circumstances may arise during your vacation (weather, illness, personal choice) where the total number of dives done is less than the number we estimate. There will be no partial refunds in these circumstances.

Complain

We want you to have the vacation you've been dreaming about. However, life doesn't always work out like that. Although the contract for the product is between you and the operator, if you have any queries concerns or Complain, please follow these guidelines to help us to help you in any conflict resolution.

  1. Act early
    Make sure that you express any dissatisfaction at the soonest opportunity so any problem can be resolved sooner rather than later.
  2. Inform the captain of the boat
    Be sure to speak to your captain, cruise director or resort manager. Tell the captain exactly what your problem is, and how he can solve your problem. In most cases, boat captains are good diplomats capable of solving your problem to your satisfaction.
  3. Not joy? We can help
    If your problem cannot be solved by the captain then Dive The World Malaysia guarantees to represent and support you and to attempt to resolve any settlement to a conclusion to your satisfaction so...
  4. Tell us as soon as possible...
    For us to represent you in any conflict resolution settlement then we must know about all the facts, events, conversations, agreements that are related to your complaint so...
  5. Keep a record
    If appropriate, then take the time to write down a factual record of what happened, when and with whom.

We'll help you to make a formal complaint, which will need to be submitted in writing no later than 28 days after the end of your diving package.

We will follow up and support you in your complaint to see that you are treated fairly by the operator and get adequate compensation from them for your troubles.

Liability Release and Assumption of Risk

Dive The World Malaysia can not be held liable for and will not be responsible for personal injuries, property damage, or wrongful death that may occur during dive activities, as a result of the inherent risks associated with scuba diving or as a result of acts or omissions of other third parties.

Scuba diving requires a certification from a recognised diving agency such as PADI. It is your responsibility that you are suitably qualified, and provide proof of such qualification upon request, to participate in any diving activities prior to you taking part. Such activities include all diving activities other than PADI Open Water Diver or Scuba Diver Course, or Discover Scuba Diving activities that allow participants to take part without a license.

Unforeseen Events

If departure of your cruise is not advisable - or may be dangerous to the life or health of the passengers or to the boat, due to conditions such as: bad weather, perils of the sea, Acts of God, political incidents, force majeure - then the captain has the sole discretion to delay or cancel the cruise departure.

Likewise, during the cruise - if bad weather or force majeure events occur that make it inadvisable for passengers to land, or for the boat to enter port - then the captain shall have the right to delay or postpone sailing until conditions allow, and make adjustments to the itinerary that may including cancellation of calls to ports, or the re-sequencing of island visits. For this reason we recommend appropriate cancellation insurance

In accordance with the industry norm, cancelled cruises entitle you to a 100% refund of monies paid, less any bank charges incurred, shortened trips to a proportionate refund, delayed trips to a choice of refund or re-scheduled trip, lengthened trips - no extra charge! Re-sequencing is not considered satisfactory justification for a refund.

In the unlikely event of a cruise being cancelled due to insufficient reservations we will alert you to this as soon as we become aware of the danger. In these circumstances we will take all reasonable steps to ensure you receive an alternative and comparable cruise.

Political Unrest

If there is any political unrest, military conflict, flight cancellations, or any other risk to customers or vessels due to political unrest, then either you or Dive The World Malaysia has the right to cancel the trip to this destination.

In this event, we will re-route your cruise to another destination at no extra cost. However, in these circumstances we are unable to consider this justification for you to cancel your cruise, and will therefore not be able to authorise any refund or compensation in this event.

Visa & Passport

Visa requirements change frequently and it is your responsibility to ensure that you meet all visa and passport validity requirements for your trip. Check the tourist information sections of your destination for guidance.

Dive Insurance

All customers should ensure they have appropriate insurance to cover the diving they will be doing during their trip. Qualified divers should take out their own dive insurance at least one month prior to arrival, and we recommend Divers Alert Network Insurance coverage.

We also highly recommend that you take out a comprehensive travel insurance policy with cover that includes cancellation, travel and personal effects.

Medical and Health

Dive The World Malaysia is not qualified to give you advice on medical matters. Therefore, be sure to discuss immunisation and prevention of tropical ailments with your doctor and follow their advice.

Miscellaneous Information We Need

When you confirm your reservation, please be prepared to provide us with the following details (we'll remind you again at the time):

  • Full names of all passengers
  • Indicate Mr/Mrs/Ms, and if you are a couple
  • Email addresses for all guests in your party
  • Flight arrival and departure details for all of your group
  • Hotel arrangements including arrival date and telephone number
  • Dive certification level
  • No. of dives
  • Date of last dive
  • Any special dietary requirements
  • Rental dive equipment sizes. Please note you are responsible for any damage caused to your rental equipment during your dive package and in the event of damage you will be charged accordingly.

Miscellaneous Terms

If there are any changes to the details supplied to us by you it is your responsibility to inform Dive The World as soon as possible. In particular Dive The World will not be responsible for problems arising from your failure to adhere to instructions in Dive The World emails or correspondence (e.g. late changes to your transfer information, your failure to satisfy permit documentation requirements etc)

All fares are quoted inclusive of taxes unless otherwise stated. Fares are subject to change without prior notice and are only guaranteed when following confirmation of the contract.

It is incumbent upon you to ensure that you meet the passport, visa, health requirements of the countries you wish to visit and those that you transit.

Like other online sales agents our website will NOT stop you from making impossible bookings such as two different liveaboard trips at the same time or where you book diving on the same day as a later flight. It is your responsibility to ensure that you do not make such reservations.

We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating Dive The World there may be times when obvious errors occur. For example, very occasionally, this may result in a price, product or other detail displayed or presented on our websites being incorrect. In this case we will do our best to correct the terms or revise them to mutual satisfaction, notwithstanding we reserve the right to cancel that contract, but this of course will be without any liability to you.
