The Compliance Branch works within WSDOT and with Federal, State, and Local agencies to develop and implement policies, procedures, and training to ensure environmental compliance for WSDOT activities. This program also seeks ways to streamline processes to increase efficiency and improve compliance.

Branch Functions

The Compliance Branch is responsible for guiding WSDOT compliance with Federal, State, and Local laws and regulations. We assess needs and develop improvements to the existing environmental process. We advise WSDOT modes and regions regarding environmental regulations, policies, and procedures that are required for environmental compliance. We also provide training for WSDOT modes and regions, resource agency, and local agency staff on these issues.

The Branch has four primary functions:

  • Providing Guidance on Environmental Documentation
  • Providing Assistance on Environmental Permitting
  • Maintains WSDOT's Environmental Geographic Information System (GIS)
  • Developing & Coordinating WSDOT's Environmental Management System

Environmental Documentation (NEPA/SEPA)

The Compliance Branch is involved in the application of the federal NEPA and state SEPA environmental review processes to transportation projects requiring an Environmental Impact Statement (EIS) or an Environmental Assessment.

More specifically, the Compliance Branch provides the following services to WSDOT Regions, Modes, Highways and Local Programs offices and local transportation agencies:

  • Lead Project Development
  • Serve on EIS Interdisciplinary Teams
  • Provide NEPA and SEPA Environmental Review policy and technical guidance
  • Review Environmental Documents for technical and legal sufficiency
  • Lead the technical review of environmental documents by WSDOT discipline specialists 
  • Lead the formal approval of EIS and EA documents
  • Maintain a statewide environmental document database
  • Lead environmental documentation process improvements and streamlining efforts

Signatory Agency Committee (SAC) Agreement  
Effective September 17, 2002, the 1996 NEPA/404 Merger Agreement was revised to include several process improvements.  Development of the revised SAC Agreement was a collaborative process involving the eight state and federal agencies that are signatory to the Agreement.

Signatory Agency Committee (SAC) Agreement Receives Annual Evaluation
The Environmental Services Compliance Branch recently completed the 2004 SAC Monitoring and Evaluation Report.  The report applies specific performance measures to six transportation projects to help measure how well the agreement is working. 

Permit Program

We are working to create a more effective environmental compliance process for WSDOT activities to meet the following goals:

  • Streamline the permit process
  • Provide predictability and consistency in the permitting process
  • Create better coordination and understanding between WSDOT and Resource Agencies
  • Establish environmental compliance standards for WSDOT activities

The Compliance Branch is responsible for initiating the following actions that promote these concepts:

  • Develop Programmatic Permits for various WSDOT activities. Click here to see a list of current General Permits.
  • Develop and implement Interagency Agreements such as Memoranda of Agreement, Memoranda of Understanding or Implementing Agreements between WSDOT and Resource Agencies.
  • Develop guidance regarding regulatory requirements for various WSDOT activities. 
  • Provide agency-wide review and comment regarding proposed regulatory changes.

Statewide Water Quality Permits for Pesticide Applications for WSDOT
These links are to the permits that  list the conditions WSDOT must comply with in order to apply pesticides for the control of noxious aquatic weeds and nuisance plant and algae control on WSDOT construction sites, mitigation sites, and right of ways.

Environmental Management System (EMS)

We coordinate the development and functioning of the Department's Environment Management System (EMS).  A formal EMS is a tool used by enterprises across the country and around the world to improve environmental performance and compliance. As part of that effort, each WSDOT region has developed environmental compliance plans to help ensure compliance with environmental regulations during construction activities.
